Common use of Use of a Train Clause in Contracts

Use of a Train. Path is not exclusive Subject to clause 3.1(a), the Operator’s right to operate a Service on a Train Path or a Path Usage does not give the Operator an exclusive right to any Train Path or Path Usage. Notwithstanding the foregoing, no two Trains (whether the Operator’s Trains or the Trains of another user of the Network) will be allotted scheduled arrival or departure times such that there are conflicts in arrival or departure times having regard to the Safeworking Rules.
