Common use of Use of Department Facilities Clause in Contracts

Use of Department Facilities. If the use of Facilities is authorized by the Commercial Use Agreement, the Concessionaire shall: a. submit a Repair and Maintenance Plan prior to commencing operations under this Agreement; b. implement the Department-approved Repair and Maintenance Plan prior to commencing operations under this Agreement; and c. maintain and repair the Facilities pursuant to the maintenance and repair schedule agreed between the Concessionaire and the Department, as more particularly detailed in the Department-approved Repair and Maintenance Plan.
