Common use of Use of Environmental Consultant Clause in Contracts

Use of Environmental Consultant. Buyer will have the period from the Execution Date until the Defect Notice Date to conduct an investigation of the environmental condition of the Assets, which investigation shall be subject to the limitations in Section 3.2. Should Buyer elect to conduct such an investigation, Buyer will employ an environmental consultant reasonably acceptable to Seller (the “Environmental Consultant”) to determine the existence of any Environmental Defects and the Remediation Costs, if any, associated therewith.

Use of Environmental Consultant. Should Buyer elect to conduct such an investigation, Buyer will have the right to employ an a qualified, independent third Person environmental consultant reasonably acceptable to Seller selected by Buyer (the “Environmental Consultant”) to determine the existence of any Environmental Defects and for the Remediation Costs, if any, associated therewith.

Use of Environmental Consultant. Buyer will have the period from the Execution Date until the Defect Notice Date to conduct an investigation of the environmental condition of the Assets, which provided that such investigation shall not be subject to conducted on-site of the limitations in Section 3.2Assets. Should Buyer elect to conduct such an investigation, Buyer will employ an New Tech Global or another environmental consultant reasonably acceptable to Seller (the “Environmental Consultant”) to determine the existence of any Environmental Defects and the Remediation Costs, if any, associated therewith.
