Common use of Use of PHI Clause in Contracts

Use of PHI. Business Associate may use PHI as necessary (i) for performing the Agreement Services, (ii) for the proper management and administration of the Business Associate, or (iii) for carrying out its legal responsibilities, provided in each case that such Uses are permitted under federal and state law. Covered Entity shall retain all rights in the PHI not granted herein.

Use of PHI. Business Associate may use PHI as necessary solely for Facility’s benefit and only (i) for the purpose of performing the Agreement Servicesservices for Facility as such services are defined in Business Arrangements, and (ii) as necessary for the proper management and administration of the Business Associate, Associate or (iii) for carrying to carry out its legal responsibilities, provided in each case that such Uses uses are permitted under federal and state law. Covered Entity Facility shall retain all rights in the PHI not granted herein. Use and disclosure of de-identified health information is not permitted unless expressly authorized in this Agreement or in writing by Facility.
