Use of the Card. You may use the Card to obtain legal goods and services from any person or establishment accepting the Card (“Purchase(s)”), and obtain loans (“Cash Advance(s)”) from us up to the applicable limits on your Account and to take advantage of other features of the Card. As used in this Agreement, the term “Purchases” will include Purchases, and the term “Cash Advances” will include; a) Cash Advances, b) Convenience Checks, c) obtaining funds through an automated teller machine (ATM) or a financial institution, d) purchasing a wire transfer, money order, foreign currency, travelers cheques, or stored value load, e) engaging in another similar transaction, or f) Balance Transfers. As used in this Agreement, all amounts charged to an Account, which include Purchases, Cash Advances, the Annual Card fee, if any, or other fees, and any Interest Charges imposed under Agreement, will be called “Charges”. Charges included (but not limited to) any Purchase, Balance Transfer, Cash Advance or Convenience Check in which you have evidenced intent to incur a Charge, regardless of whether you have signed a charge form. You are responsible for paying all amounts charged to the Account by either you or any Additional Cardholders. You agree to notify us at once if the Card or any Convenience Checks we may issue on your Account are lost or stolen, or if you suspect they are being used without your permission. You agree to use the Account only for legal purchases of goods and services. Cards may not be used for gambling purposes, whether on the internet or otherwise. If you do use your Card for illegal purposes or gambling, you will be in default under this Agreement and we may terminate your Account, but you still will be liable to us for all Charges relating to such transactions and all other transactions on your Account. You should not use the Card after the expiration date. If you want to cancel your Account or any Additional Cards, you must contact us and destroy the Card or any Additional Cards. We reserve the right to deny authorization for any requested Charge. All Purchases are affected at the option of the Seller and Cash Advancing Financial Institution and Solvay Bank shall not be responsible for refusal by any Seller or Cash Advancing Financial Institution to honor the Cards or any Related Card. Any refund, adjustment or credit allowed by Seller shall not be by cash but rather by a credit advice to Solvay Bank which shall be shown as a credit on Cardholders account statement with Solvay Bank.

Use of the Card. To activate the Card you will need to log onto the Card Partner App or Card Partner’s Website and use the activate card function. We will be entitled to assume that a Transaction has been Authorised by You may where (i) the magnetic strip on the Card was swiped by the Merchant; (ii) the Card was inserted into a chip & PIN device and the PIN was entered; (iii) relevant information was supplied to the Merchant that allows them to process the Transaction, for example, providing the Merchant with the 3-digit security code on the back of the Card in the case of an internet or other non-face-to-face Transaction; or (iv) the Card is tapped against a contactless-enabled reader and accepted by such reader. The Cardholder should only use the Card as permitted by the Business. If the Cardholder uses the Card, we are entitled to obtain legal goods and services from any person or establishment accepting presume that the Cardholder has the Business’ permission to spend the Available Balance until notified to the contrary by the Business. The Cardholder can use the Card up to the amount of the Available Balance for Transactions (“Purchase(s)”)i) via the Internet, (ii) at Merchants and obtain loans (“Cash Advance(s)”iii) to make cash withdrawals from ATMs, provided that such application is included in the card program. We will deduct the value of the Transactions from the Available Balance in the Account. We will also deduct any applicable Fees as soon as they become payable by the Business based upon the Fees Schedule. ATM withdrawals may also be subject to fees, foreign exchange rates, maximum withdrawal limits, rules and regulations of the relevant ATM operator or bank. It is your responsibility to check whether any such additional fees apply, as they cannot be refunded once the cash has been withdrawn. Like other card issuers, we cannot guarantee a Merchant, an ATM operator or a bank will accept the Card. We may at any time suspend, restrict or terminate the Card and/or the Account, refuse to issue or replace a Card or refuse to authorise a Transaction for reasons relating to the following: ● if we have reasonable grounds to believe that the Card is being in a way which is not approved by the Business; ● if we have reasonable grounds to believe that the security of the Card has been compromised or suspect that the Card is being used in an unauthorised or fraudulent manner; ● if there is insufficient Available Balance in the Account at the time of a Transaction to cover the amount of the Transaction and any applicable Fees; ● if there is an outstanding Shortfall in the Account; ● if we have reasonable grounds to believe that you are acting in breach of this Agreement; ● if we have reasonable grounds to believe that a Transaction is potentially suspicious or illegal (for example, if we believe that a Transaction is being made fraudulently) or because of errors, failures (whether mechanical or otherwise) or refusals by Merchants, payment processors or payment schemes processing Transactions, or ● if we need to do so in order to comply with the law. If we do this, we will inform you of the action taken and its reasons in advance or, if that is not possible, immediately after, unless to do so would compromise reasonable security measures or be otherwise unlawful. We will reactivate the Account and where appropriate issue you with a replacement Card if after further investigations we reasonably believe that the reasons for the action no longer apply. The Business will remain responsible to the Issuer for the use of the Card. Your ability to use or access the Card may occasionally be interrupted, for example, if we need to carry out maintenance on our systems. Please contact us using the contact details set out in clause 2 to notify us of any problems you are experiencing using the Card or Account and we will endeavour to resolve any problem. You can manage the Card and view your e-statements by accessing the Account online via the Card Partner's Website or Card Partner App. You may at any time view the details of the Transactions in the Account using the relevant credentials. You must keep your credentials safe and not disclose them to anyone. The Account will include all Transactions notified to us up to the applicable limits on your Account and to take advantage of other features evening of the Cardprevious Business Day. As Your transaction information (“e-statement”) will contain: (i) a reference enabling you to identify each Transaction; (ii) the amount of each Transaction; (iii) the currency in which the Card is debited/credited; (iv) the amount of any Transaction charges including their break down, where applicable; the exchange rate used in this Agreement, the term “Purchases” will include Purchases, Transaction and the term “Cash Advances” will include; a) Cash Advances, b) Convenience Checks, c) obtaining funds through an automated teller machine (ATM) or a financial institution, d) purchasing a wire transfer, money order, foreign currency, travelers cheques, or stored value load, e) engaging in another similar transaction, or f) Balance Transfers. Use of the Card. You All Boost Beyond Cards are issued with contactless functionality and are MasterCard PayPass enabled. Once the Boost Beyond Card is activated and you have topped-up the Card with sufficient funds, you may start to use the Boost Beyond Card to purchase goods and services worldwide anywhere a MasterCard card is accepted and also to access cash at ATMs or financial institutions displaying the MasterCard name and/or logo, whereupon for ATM functionality, Boost shall duly inform the Cardholder within the App of its availability. Each time you use the Card to obtain legal purchase goods or services, you authorize us to deduct your funds from your Card Account. The Card is non-transferable and services from shall only be used exclusively by you as the Cardholder. Your Card shall not be pledged by you as security for any person or establishment accepting the Card (“Purchase(s)”), and obtain loans (“Cash Advance(s)”) from us up to the applicable limits on your Account and to take advantage of other features of the Card. Use of the Card. You may Purchasing and cash advance privileges (if allowed) on the Card and Account are provided by the Bank pursuant to the GSA Contract and one or more task orders between the Bank and my Agency/Organization, and are subject to this Agreement. We may, in our sole discretion, pursue Authorized Users for payment of their Charges if you fail to pay those Charges. Use of the Card. You may 8.1 To activate the Card, you will need to log onto the User App or Website and use the ‘activate card’ function. 8.2 We will be entitled to assume that a Transaction has been Authorised by you where (i) the magnetic strip on the Card was swiped by the merchant; (ii) the Card was inserted into a chip & PIN device and the PIN was entered; (iii) relevant information was supplied to the merchant that allows them to process the Transaction, for example, providing the merchant with the 3-digit security code on the back of the Card in the case of an internet or other non-face-to-face Transaction; or (iv) the Card is tapped against a contactless-enabled reader and accepted by such reader. 8.3 Your Cardholder should only use the Card as permitted by the Business. If the Cardholder uses the Card, we are entitled to obtain legal goods and services from any person or establishment accepting presume that the Cardholder has the Business’ permission to spend the Available Balance until notified to the contrary by the Business. The Cardholder can use the Card up to the amount of the Available Balance for Transactions (“Purchase(s)”)i) via the Internet, (ii) at Merchants and obtain loans (“Cash Advance(s)”iii) to make cash withdrawals from ATMs, provided that such application is included in the card program. We will deduct the value of the Transactions from the Available Balance in the Account. We will also deduct any applicable Fees as soon as they become payable by the Business based upon the Fees Schedule. ATM withdrawals may also be subject to fees, foreign exchange rates, maximum withdrawal limits, rules and regulations of the relevant ATM operator or bank. It is your responsibility to check whether any such additional fees apply, as they cannot be refunded once the cash has been withdrawn. Like other card issuers, we cannot guarantee a Merchant, an ATM operator or a bank will accept the Card. We may at any time suspend, restrict or terminate the Card and/or the Account, refuse to issue or replace a Card or refuse to authorise a Transaction for reasons relating to the following: ● if we have reasonable grounds to believe that the Card is being in a way which is not approved by the Business; ● if we have reasonable grounds to believe that the security of the Card has been compromised or suspect that the Card is being used in an unauthorised or fraudulent manner; ● if there is insufficient Available Balance in the Account at the time of a Transaction to cover the amount of the Transaction and any applicable Fees; ● if there is an outstanding Shortfall in the Account; ● if we have reasonable grounds to believe that you are acting in breach of this Agreement; ● if we have reasonable grounds to believe that a Transaction is potentially suspicious or illegal (for example, if we believe that a Transaction is being made fraudulently) or because of errors, failures (whether mechanical or otherwise) or refusals by Merchants, payment processors or payment schemes processing Transactions, or ● if we need to do so in order to comply with the law. If we do this, we will inform you of the action taken and its reasons in advance or, if that is not possible, immediately after, unless to do so would compromise reasonable security measures or be otherwise unlawful. We will reactivate the Account and where appropriate issue you with a replacement Card if after further investigations we reasonably believe that the reasons for the action no longer apply. The Business will remain responsible to the Issuer for the use of the Card. Your ability to use or access the Card may occasionally be interrupted, for example, if we need to carry out maintenance on our systems. Please contact us using the contact details set out in clause 2 to notify us of any problems you are experiencing using the Card or Account and we will endeavour to resolve any problem. You can manage the Card and view your e-statements by accessing the Account online via the Card Partner's Website or Card Partner App. You may at any time view the details of the Transactions in the Account using the relevant credentials. You must keep your credentials safe and not disclose them to anyone. The Account will include all Transactions notified to us up to the applicable limits on your Account and to take advantage of other features evening of the Cardprevious Business Day. Payment of any amounts owing relating to these transactions remain your liability and responsibility. 5.10 The Cardholder must take all reasonable steps to prevent any authorised use of the Card by: 5.10.1 doing everything that is necessary to prevent it from being lost, stolen and/or used wrongfully; 5.10.2 ensuring that any record of the PIN is kept separate from the Card in a safe place; and 5.10.3 not allowing anybody, unless specifically authorised by you thereto to obtain knowledge of the PIN 5.11 If the Card, Card Number or PIN: 5.11.1 is lost, stolen and/or used wrongfully; or 5.11.2 is used by any person other than the Cardholder or establishment accepting Card User so authorised by you; We must be notified immediately at our Nedbank Card Division in Windhoek on the telephone numbers provided from time to time (on the monthly statement). We must also be notified immediately if you or the Card User has reason to believe or suspect that this has happened. The Cardholder will be provided with a reference number during the telephone call. It is important that the Cardholder keep a record of this reference number, as the Cardholder must be able to provide it to us whenever the Cardholder is requested to do so. By signing the voucher the Card User confirms that the information on it is correct and the Card user will be liable for and must repay us all amounts we pay or have to pay in respect of Card Transactions. Use of the Card. with Digital Wallets A digital wallet (“Wallet”) provides another way for you to make purchases with your Card. A digital wallet is a service provided by another company (such as Apple Pay, Android Pay, Samsung Pay, etc.), that allows you to use your Card to enter into transactions where the Wallet is accepted. A Wallet may not be accepted at all places where your Card is otherwise accepted, and your Card may not be eligible for all the features and functionalities of the Wallet. Any use of your Card in or through the Wallet continues to be subject to all terms and conditions of this Agreement. We may terminate your access to or use of your Card with a Wallet at any time and for any reason, including if you violate any of the terms or conditions of this Agreement. You can add or remove your Card from a Wallet by following the instructions provided by the Wallet provider. By doing this, you agree to allow us to share your Card information with the Wallet provider. You may be required to take additional steps to authenticate yourself before your Card is added to the Wallet. We do not charge you any additional fees for adding your Card to a Wallet or for using your Card in the Wallet. However, any fees and charges that would apply when you use your Card outside the Wallet will also apply when you use a Wallet to make purchases with your Card or otherwise access your Card. The Wallet provider and other third parties such as wireless companies or data service providers may charge you fees. The digital version of your Card in a Wallet may, in our sole discretion, be automatically updated or upgraded without notice to you. We are not the provider of the Wallet, and we are not responsible for providing the Wallet service to you or for ensuring that your Card is compatible with any Wallet service. You should frequently review your Card Account to check and verify your Available Balance before using your Card. You must always ensure that there are sufficient funds in your Card Account to pay for each transaction and to cover the total amount transacted on your Card Account, including purchases, recurring transactions, fees and other charges. If the total amount in your Card account is insufficient, your transaction will be declined and in the case of recurring declined transactions, you would have to make your own arrangements for payment with the recurring merchant, and we shall not use the Card after the expiration datebe liable for any penalty or late payment interest charged by such merchant on you. Take note, as part of our CDD requirements and security monitoring process, Boost reserves the right to review your Card Account activities and any Additional CardsTransaction at any point in time in order to protect you and your funds and to ensure the validity, safety and security of your Card Account against money laundering, terrorism financing, fraudulent or illegal activities. As a provider of financial services, Boost also plays an important role in the fight against financial crime, money laundering and terrorist financing activities and as a result, the Applicable Laws require us to obtain, verify and record personal and private information about our customers and to conduct periodic account reviews. These processes often include steps that involve additional verification and validation of identity, payment or funding sources and instructions, and of other Transaction information which may require us to contact you must contact us further for the relevant information, which may result in delay in the processing of a Transaction until such verification and destroy validation is satisfactorily completed. In the Card or event that your Transaction is subject to any Additional Cardsprocess for additional verification and/or validation (including AML compliance checks), your Transaction may be put on hold while we collect and confirm the source of the funds and complete the verification and validation process. We reserve the right to deny authorization refuse to process Transactions for certain individuals, including without limitation, individuals from sanctioned or high risk countries, individuals who have been blacklisted by any financial institutions, licensed banks or e-money issuers in Malaysia or abroad, individuals who are included in our internal lists and the relevant money laundering and terrorism financing information sources, as well as global lists or databases provided by local or foreign authorities (including but not limited to Bank Negara Malaysia), the United Nations Security Council Resolutions (UNSCR), Office of Foreign Assets Control (OFAC), or who are deemed as Specially Designated Nationals (SDNs), included under any lists or databases as provided or recommended by the Financial Action Task Force (FATF) and such other lists as may be issued from time to time by relevant government agencies. We may also refuse to process any Transaction on behalf of individuals that may appear on any list of politically exposed persons (PEPs) or that are family members or considered close associates of such PEPs (RCAs). If the Card is used in a manner other than as permitted by this Cardholder Agreement, to the extent permitted by law, we may, at our option and without waiving any of our rights, recognize the transactions and debit or credit the Card accordingly. Any online betting and/or gambling activities are prohibited and you agree that we do not owe you any duty and/ or obligation whatsoever to monitor and block the use of the Card for any requested Chargeunlawful activities.
