PURCHASE OF GOODS AND SERVICES. The ACES Participating Agency may issue an order for goods and/or services as set forth in this contract. The procurement of goods and services subject to this Agreement shall be conducted in accordance with and subject to the relevant statues, ordinances, rules, and regulations that govern each party’s procurement practices.
PURCHASE OF GOODS AND SERVICES. All purchasing and receiving of merchandise for the University must be coordinated, authorized, or handled by the Purchasing Agent in the Procurement Services Office. Requisitions for supplies and equipment should be submitted well in advance of need to the Purchasing Agent, who is the only authorized procurement agent for the University. All purchases of goods and services follow the rules and regulations of the State of Georgia. Employees of the University are not allowed to purchase goods or services for personal use through University channels. Unauthorized purchases or receipt of items for the University may result in personal liability for the cost thereof. Unauthorized use of the purchasing card (P-Card) can result in termination and criminal prosecution. PURCHASE OF GOODS AND SERVICES. In the case of purchases of goods and services We shall levy a Finance Charge from the date We pay the vendor of the goods or service provider. There shall be no grace period during which You may settle the balance without incurring a Finance Charge.
PURCHASE OF GOODS AND SERVICES. Notwithstanding any other provision of this Agreement, We shall purchase, as Your agent and not on Our own behalf, all goods and services to be provided by outside vendors under this Agreement as may otherwise be subject to sales or other tax if purchased by Us. The title and benefit of all such goods and services shall pass directly from such vendors to You.
PURCHASE OF GOODS AND SERVICES. A. All products and services shall be procured in accordance with all appropriate procedures governing competitive bids and competitive proposals, as required by the laws of the State of Texas. B. The parties will be able to purchase from those contracts established by the other party where notice has been given in the bid specifications and the successful bidder has accepted terms for cooperative purchasing agreements for local governments. C. The parties hereto agree that the ordering of products and services through this Agreement shall be their individual responsibility and that the successful bidder or bidders shall bill each party directly or, if deemed advantageous by the parties, to both parties. D. The parties agree to pay successful bidders directly for all products or services received from current revenues available for such purchase. Each party shall be liable to the successful bidder only for products and services ordered by and received by such party and shall not, by the execution of this Agreement, assume any additional liability. E. The parties do not warrant and are not responsible for the quality or delivery of products or services from the successful bidder. The participating parties shall receive all warranties provided by the successful bidder for the products or services purchased. F. If any dispute arises between individual parties and a successful bidder, such dispute shall be handled by and between the participating party’s governmental body and the bidder.
PURCHASE OF GOODS AND SERVICES. A commercial property owner who has entered into a commercial PACE agreement under this chapter may purchase directly all goods and services for the energy savings improvements described in the commercial PACE agreement, subject to any applicable vendor certification required by the trust and other requirements of the trust. Goods and services purchased by a commercial property owner for the energy savings improvements under a commercial PACE agreement are not subject to any public procurement ordinance or statute. PURCHASE OF GOODS AND SERVICES. (a) I may use my Card to purchase goods or services for personal use only and at the outlets of any contracted card associations merchant, subject to the credit limit PrimeCredit has assigned to me from time to time. (b) PrimeCredit is not liable or responsible in any way, should my Card or my PIN be rejected by any merchant, person or Terminal or if any Terminal is not available for any reason (such as malfunction, defect, power or failures of any kind). PrimeCredit is also not responsible in any way for any defects, deficiencies or problems with any goods or services supplied to me by any merchant through the use of the Card, nor will PrimeCredit be responsible for any benefits, discounts or promotion programs of any merchants or relevant card associations that are available to me through the use of my Card. My obligation to PrimeCredit under this Agreement will not be reduced by any claim or complaint made by me against a merchant and I will pay PrimeCredit the full amount shown in the Statement Balance on or before the relevant due date, notwithstanding any non-delivery, non-performance or defect in any such goods and services, or any claims or disputes between a merchant and I. I shall be solely responsible for resolving any such disputes or complaints with the relevant merchant directly, in particular in relation to any autopay or direct debit, installment or financing arrangements to charge from my Card Account with the merchant. In the event of any dispute that I may have with a merchant, PrimeCredit has the right not to act on any request to set up, modify or terminate such autopay or direct debit, installment or financing arrangements. PrimeCredit is not liable to me for any losses and damages in this respect.
PURCHASE OF GOODS AND SERVICES. 1.7.1 You may use your Card to obtain goods or services at the outlets of any contracted card associations (e.g. Visa, Mastercard, JCB, UnionPay etc.) merchant, subject to the credit limit set by us. 1.7.2 We shall not be responsible if any merchant does not honour the Card for any reason whatsoever. Nor shall we be liable or responsible in any way for goods or services supplied to you by a merchant. Any complaint that you may have against the merchant must be resolved by you and the merchant concerned, and the existence of any claim or dispute between two of you shall not relieve your obligation to settle any sum outstanding to us. 1.7.3 Any request you made to any merchant – via mail, fax, electronic means or telephone – for the supply of goods or services to be charged to the relevant Card Account shall constitute authority for the merchant to issue a sales draft for the amount to be charged. If this sales draft is endorsed “Mail Order”, “Fax Order”, “Electronic Means Order” or “Telephone Orderaccording to the circumstances, it shall be deemed as having been duly signed by you.
PURCHASE OF GOODS AND SERVICES. The Board of Directors is authorized to purchase goods and services.
