LIABILITY FOR TRANSACTIONS. Save only to the extent that your liability has been expressly excluded in accordance with Clause 4.3(a) and (b) above, you shall be liable for all Card Transactions, Cash Advances, whether or not executed with your knowledge or authority or that of the Principal Cardmember and/or any Supplementary Cardmember(s) or any other account holder, regardless of how such transactions were effected and notwithstanding that any spending limit applicable to any Card shall have been exceeded, including without limitation: a. where effected via any Digital Payment Service, Enabled Device(s) and/or where any Card has been enrolled on multiple Enabled Device(s); and/or b. where arising in connection with any negligence on your part (which shall be deemed to include without limitation where you fail to adopt the security measures referenced in Clause 22.2), or any security risks, including as referenced in Clause 22.1. For the avoidance of doubt, we shall be entitled, at our sole and absolute discretion, to allow Card Transactions to be effected notwithstanding that the available Card spending limit has been exceeded, and shall not be liable to you for any loss, charges or damages resulting therefrom. You warrant and confirm that you have obtained all requisite consents for the use of any Enabled Device(s) in connection with Digital Payment Services. We shall provide the Principal Cardmember a Billing Statement on a monthly basis or other periodic basis listing the transactions incurred by the Principal Cardmember and the Supplementary Cardmember(s), where applicable, in respect of each Card Account(s).

LIABILITY FOR TRANSACTIONS. You are liable for all authorised card transactions and cash advances. In addition, you shall be responsible for unauthorised transactions made, up to S$100, referred to in Clause 3.3 above. We shall send the Principal Cardholder a Card Account Statement (and, where applicable, an electronic statement shall be made accessible to the Principal Cardholder through the DBS internet banking service and/ or such other channel(s) as we may designate from time to time by notice in writing to you) every month listing the transactions incurred by the Principal Cardholder and the Supplementary Cardholder(s) (where applicable) in respect of each Card Account(s).

LIABILITY FOR TRANSACTIONS. 9.1 Notwithstanding any other provisions of this Agreement, the Employer shall (without prejudice to the Bank's rights against the Cardholder) be wholly liable to the Bank for the value of all Card Transactions effected by the Cardholder (whether voluntarily or otherwise) as well as all amounts properly debited to the Card Account (wherever effected and whether or not (a) that transaction has been undertaken for the business purposes of the Employer or (b) that transaction may have arisen as a result of actions of the Cardholder without the Employer's authority or (c) authorisation has been obtained from the Bank in respect of that transaction or (d) the Card has been used in breach of any other terms contained herein or the Conditions of Use or (e) the Employer's Programme credit limit may be exceeded) as well as all fees, interest and charges payable under this Agreement. This liability shall include any transactions undertaken after the cancellation of a Card, subject however to the terms of this Clause. 9.2 The Card is the property of the Bank and is not transferable. The loss or theft of any Card, or (in the case of Corporate Cards) the loss, theft or disclosure to a third party of any number used in relation to any cash advance or ATM function or facility incorporated in a Corporate Card, should be reported immediately upon discovery of loss, theft or disclosure (to the Bank's Card Centre in the Hong Kong SAR – tel: 0000 0000 – or, if overseas, to any member of MasterCard). The Employer shall be fully liable for all cash advances effected as a result of the unauthorised use of any such number. In respect of all other transactions debited to any Card Account as a result of the unauthorised use of a Card ("Non-cash Transactions") until notification of its loss, theft or disclosure has been received by the Bank or by a member of MasterCard, except in the circumstances described below, the maximum liability for Non-cash Transactions shall be the assigned credit limit of the Card Account for the Employer. The Employer shall be fully liable for all Non-cash Transactions, without limit, if the Employer and/or the Cardholder has acted fraudulently or with gross negligence in using or safeguarding the Card or has knowingly (whether voluntarily or otherwise) provided that Card or let the Card be taken by a third party or has failed to make a report in accordance with this Clause as soon as reasonably practicable upon discovery of loss or theft. LIABILITY FOR TRANSACTIONS. The Principal Cardmember shall be fully liable and responsible for all Card Transactions effected by the use of the Principal Card and Supplementary Card(s), whether or not executed with the Principal Cardmember’s knowledge or authority and notwithstanding that the available Designated Account balance or Card spending limit (as the case may be) applicable to the Card shall have been exceeded. For the avoidance of doubt, we shall be entitled, at our sole and absolute discretion, to allow Card Transactions by the Principal Card and/or Supplementary Card to be effected notwithstanding that the available Designated Account balance or Card spending limit have been overdrawn or exceeded, and shall not be liable to you for any loss, charges or damages resulting therefrom.
LIABILITY FOR TRANSACTIONS. Subject to the provision of Clause 6, you agree to accept full responsibility for any transaction you make using the Card, regardless of whether or not you have authorised the amount shown and this applies to:- (a) any transaction that involves a duly completed sales draft, transaction record, credit voucher, cash disbursement draft, and/or other charge record bearing the imprint or another form of reproduction of the information embossed on the Card; (b) our record of cash advances; and (c) any sales draft relating to any order for goods and/or services placed over the telephone, or by any other method of purchase in which the Card was not presented but the Card number and other required information were provided.
