Common use of Use of the Platform Clause in Contracts

Use of the Platform. When using our Platform, User is responsible for its use of the Platform. You agree to the following: ● You way not copy, distribute or disclose any part of the Platform in any medium, including without limitation by any automated or non-automated “scraping”; ● You may not attempt to interfere with, compromise the system integrity or security, or decipher any transmissions to or from the servers running the Platform; ● You may not use any robot, spider, crawler, scraper or other automated means or interface not provided by us to access the Platform or to extract data; ● You may not use the Platform on a computer that is used to operate nuclear facilities, life support, or other mission critical applications where life or property may be at stake; ● You may not decompile, reverse engineer, disassemble, modify, rent, sell, lease, loan, distribute, or create derivative works or improvements to the Platform or any portion of it; ● You may not access our Platform in an attempt to build a similar or other competitive product; ● You may not use the Platform in an unlawful manner; ● You may not take any action that imposes, or may impose at our sole discretion, an unreasonable or disproportionately large load on our infrastructure; ● You may not collect or harvest any personally identifiable information, including account names, except where permitted, from the Platform; ● You may not impersonate any person or entity or misrepresent your affiliation with a person or entity; ● You may not violate or infringe other people's intellectual property, privacy, or other contractual rights while using our Platform; ● You may not violate any requirements, procedures, policies or regulations of networks connected to Trifecta; ● You may not sell, lease, loan, distribute, transfer, or sublicense the Trifecta Services; ● You may not interfere with or disrupt the Platform; ● You may not violate any US state or federal laws or regulations and you solely are responsible for such violations; ● You agree not to use the Platform in any way that is: misleading, unlawful, defamatory, obscene, invasive, threatening, or harassing. ● You agree that you will not hold Trifecta responsible for your use of our Platform; and ● You agree not to cause, or aid in, the disruption, destruction, manipulation, removal, disabling, or impairment of any portion of our Platform, including the de-indexing or de-caching of any portion of our Platform from a thirty party’s website, such as by requesting its removal from a search engine. If you are discovered to be undertaking any of the aforementioned actions your privileges to use our Platform may at our discretion be terminated or suspended. Additionally, if we believe that your actions may harm us or a third party we may suspend or terminate your use of the Platform. Generally, we will provide an explanation for any suspension or termination of your use of any of our Platform, but Trifecta reserves the right to suspend or terminate any account at any time without notice or explanation.

Use of the Platform. When using our Platform, User is 4.1. You are responsible for its use of the providing Your own internal facilities (including if applicable, terminal, server, software, SQL database licenses, modem and telecommunications facilities or services) necessary for accessing Platform. GObookings accepts no responsibility for any deficiency in Your internal access facilities or services. 4.2. You agree to take reasonable steps, including implementing reasonable security measures to ensure that no unauthorised person gains access to the following: ● You way not copyPlatform, distribute or disclose any part including via the Admin Portal and there is no unauthorised use of the Services. 4.3. You are responsible for any and all activity that occurs on the Platform in any mediumaccessed under Your URL, including without limitation by any automated or non-automated “scraping”; ● via the Admin Portal. You may not attempt agree that Your use of the Services, including Your access to interfere with, compromise the system integrity or security, or decipher any transmissions to or from the servers running the Platform; ● , Admin Portal, Calendars and Website will be for lawful purposes only and will comply with the AUP. You may not use any robot, spider, crawler, scraper or other automated means or interface not provided by us to access the Platform or to extract data; ● further agree that You may will not use the Platform on a computer Services breach any law, or to: 4.3.1. post or transmit any material which violates or infringes in any way upon the rights of others, which is unlawful, fraudulent, threatening, abusive, defamatory, invasive of privacy or publicity rights, vulgar, obscene, profane, hateful, or racially or ethnically or otherwise objectionable; 4.3.2. encourage conduct that is used criminal, would give rise to operate nuclear facilities, life support, civil liability or other mission critical applications where life or property may be at stake; ● You may not decompile, reverse engineer, disassemble, modify, rent, sell, lease, loan, distribute, or create derivative works or improvements to the Platform or would otherwise violate any portion of it; ● You may not access our Platform in an attempt to build law; 4.3.3. impersonate a similar or other competitive product; ● You may not use the Platform in an unlawful manner; ● You may not take any action that imposes, or may impose at our sole discretion, an unreasonable or disproportionately large load on our infrastructure; ● You may not collect or harvest any personally identifiable information, including account names, except where permitted, from the Platform; ● You may not impersonate any person or entity or misrepresent your falsely state Your affiliation with a person or entity; 4.3.4. upload, post, transmit or otherwise make available any content that infringes the rights of another party including but not limited to trademark, copyright and other intellectual property rights; 4.3.5. transmit or otherwise make available any material that contains software viruses or any other computer code or files designed to interrupt, destroy or limit the functionality of any computer software or hardware or telecommunications equipment; ● or 4.3.6. assist with the development of a competitive or replacement scheduling booking system. 4.4. You may and not violate or infringe other people's intellectual propertyGObookings is responsible for all End Users’ use of the Platform which must be in accordance with the AUP. Any disputes between You and an End User must be addressed between You and the End User. You should treat a booking via the Platform as merely a request in respect of a particular Calendar. GObookings will send a system generated email to confirm the booking. There is no guarantee that an End User will accept, privacybe available for, or other contractual rights while using our Platform; ● You may not violate any requirements, procedures, policies or regulations of networks connected to Trifecta; ● You may not sell, lease, loan, distribute, transferattend a booking, or sublicense follow through to complete a booking obligation for an item or person. GObookings does not accept, and excludes to the Trifecta Services; ● You may not interfere with full extent permitted by law, any responsibility for: 4.4.1. any booking or disrupt the Platform; ● You may not violate payment disputed by an End User; 4.4.2. any US state or federal laws or regulations and you solely are responsible for such violations; ● You agree not to use the Platform in any way that is: misleading, unlawful, defamatory, obscene, invasive, threatening, or harassing. ● You agree that you will not hold Trifecta responsible for your use of our Platform; and ● You agree not to cause, or aid in, the disruption, destruction, manipulation, removal, disabling, or impairment of any portion of our Platform, including the de-indexing or de-caching of any portion of our Platform claims resulting from a thirty party’s website, such as by requesting its removal from a search engine. If you are discovered to be undertaking any of the aforementioned actions your privileges to use our Platform may at our discretion be terminated or suspended. Additionally, if we believe that your actions may harm us or a third party we may suspend or terminate your fraudulent use of the Platform; 4.4.3. Generallyany breach of an agreement or offer between You and a third party; 4.4.4. any booking and/or payment obligation which was not fulfilled by You or an End user; or 4.4.5. any bookings which may, we through known or unknown reasons, overlap either partially or fully with any other booking. 4.5. You agree, and will provide an explanation for any suspension or termination of your use ensure that each Admin User agrees to promptly notify GObookings of any complaints received by You from any person relating to the Services particularly any complaints relating to use or disclosure of our Platformpersonal information or complaints of any nature relating to email delivery. 4.6. You agree You will not use GObookings name, but Trifecta reserves the right to suspend trade marks, links or terminate any account at any time without notice products on non- permission based e-mails or explanationpop-up internet advertisements. Sending unsolicited spam e-mails with a GObookings link attached may result in us terminating Your subscription.

Use of the Platform. When using our Platform, User Client is responsible for its use and the use of the PlatformPlatform by any of its Permitted Users. You agree to the following: ● You way not copy, distribute or disclose any part of the Platform in any medium, including without limitation by any automated or non-automated “scraping”; ● You may not attempt to interfere with, compromise the system integrity or security, or decipher any transmissions to or from the servers running the Platform; ● You may not use any robot, spider, crawler, scraper or other automated means or interface not provided by us to access the Platform or to extract data; ● You may not use automated bots or other software to send more messages through our Platform than humanly possible; ● You may not use the Platform on a computer that is used to operate nuclear facilities, life support, or other mission critical applications where life or property may be at stake; ● You may not decompile, reverse engineer, disassemble, modify, rent, sell, lease, loan, distribute, or create derivative works or improvements to the Platform or any portion of it; ● You may not access our Platform in an attempt to build a similar or other competitive product; ● You may not use the Platform in an unlawful manner; ● You may not take any action that imposes, or may impose at our sole discretion, an unreasonable or disproportionately large load on our infrastructure; ● You may not collect or harvest any personally identifiable information, including account names, except where permitted, from the Platform; ● You may not impersonate any person or entity or misrepresent your affiliation with a person or entity; ● You may not violate or infringe other people's intellectual property, privacy, or other contractual rights while using our Platform; ● You may not violate any requirements, procedures, policies or regulations of networks connected to TrifectaFull Frame; ● You may not sell, lease, loan, distribute, transfer, or sublicense the Trifecta ServicesPlatform or access to it or derive income from the use or provision of the Platform unless enabled through the functionality of our Platform; ● You may not interfere with or disrupt the Platform; ● You may not violate any US state law or federal laws or regulations regulation and you solely are responsible for such violations; ● You agree not to use the Platform in any way that is: misleading, unlawful, defamatory, obscene, invasive, threatening, or harassing. ● You agree that you will not hold Trifecta Full Frame responsible for your use of our Platform; and ● You agree not to cause, or aid in, the disruption, destruction, manipulation, removal, disabling, or impairment of any portion of our Platform, including the de-indexing or de-caching of any portion of our Platform from a thirty party’s website, such as by requesting its removal from a search engine. Use of the Platform. When using our Platform7.1 Blockfills shall have the right, at any time, to amend the provisions of the Agreement and the Digital Currency and CFD Addendum upon five (5) days prior notice to User; provided, however, that any amendment to the Agreement of the Digital Currency and CFD Addendum may be made effective immediately, where appropriate in Blockfills’ determination, (i) to permit the Platform or Platforms, and/or Blockfills to comply with Law; or (ii) to facilitate the continued and proper operation of the Platform or Platforms without performance interruption or degradation. 7.2 User is responsible for its agrees to not make use of the PlatformPlatform or Platforms in a manner that would violate the Law. You agree to The Platforms are not available for use by any Person in any jurisdiction where (by reason of the following: ● You way not copyPerson’s domicile, distribute status or disclose any part otherwise) the availability of the Platform in any medium, including without limitation by any automated or non-automated “scraping”; ● You may Platforms is prohibited. Persons to whom such prohibitions apply must not attempt to interfere with, compromise the system integrity or security, or decipher any transmissions to or from the servers running the Platform; ● You may not use any robot, spider, crawler, scraper or other automated means or interface not provided by us to access the Platform or Platforms. 7.3 Subject to extract data; ● You may the User’s compliance with the terms and conditions of this Agreement, the Digital Currency and CFD Addendum, the User is granted a limited, revocable, nonexclusive, non-transferable license to access and use the Platform during the term of this Agreement, for purposes and in a manner consistent with the terms of this Agreement, Digital Currency and CFD Addendum. 7.4 User shall not alter, modify or manipulate the content of the Data in any way. User shall not use the Platform Data for any purpose other than in connection with trading on a computer that is used to operate nuclear facilities, life support, or other mission critical applications where life or property may be at stake; ● You may not decompile, reverse engineer, disassemble, modify, rent, sell, lease, loan, distribute, or create derivative works or improvements to the Platform or any portion of it; ● You may not access our Platform in an attempt to build a similar or other competitive product; ● You may not use the Platform in an unlawful manner; ● You may not take any action that imposes, or may impose at our sole discretion, an unreasonable or disproportionately large load on our infrastructure; ● You may not collect or harvest any personally identifiable information, including account names, except where permitted, from the Platform; ● You may not impersonate any person or entity or misrepresent your affiliation with a person or entity; ● You may not violate or infringe other people's intellectual property, privacy, or other contractual rights while using our Platform; ● You may not violate any requirements, procedures, policies or regulations of networks connected to Trifecta; ● You may not sell, lease, loan, distribute, transfer, or sublicense the Trifecta Services; ● You may not interfere with or disrupt the Platform; ● You may not violate any US state or federal laws or regulations and you solely are responsible for such violations; ● You agree not to use the Platform in any way that is: misleading, unlawful, defamatory, obscene, invasive, threatening, or harassing. ● You agree that you will not hold Trifecta responsible for your use of our Platform; and ● You agree not to cause, or aid in, the disruption, destruction, manipulation, removal, disabling, or impairment of any portion of our Platform, including the de-indexing or de-caching of any portion of our Platform from a thirty party’s website, such as by requesting its removal from a search engine. If you are discovered to be undertaking any of the aforementioned actions your privileges to use our Platform may at our discretion be terminated or suspended. Additionally, if we believe that your actions may harm us or a third party we may suspend or terminate your use of the Platform. GenerallyUser also shall not publish or redistribute the Data, we or otherwise directly or indirectly provide any third party with access to the Data (or any Data or information derived from the Data). 7.5 User acknowledges and agrees that the transactions the User executes through the Platform may be with Persons that are dealers in digital currency and CFDs, as applicable, and that they may engage in transactions in digital currency and/or CFDs, as applicable, before, after or simultaneously with User entry of an Order at different prices from those provided through the Platform and may have material non-public information with respect thereto. 7.6 User acknowledges and agrees that the transactions the User executes through the Platform will provide an explanation for be subject to the set Blockfills Commission Fees and any suspension or termination of your use of any of our bid/offer spread included in the digital currency and/or CFD pricing offered to the User through the Platform, but Trifecta reserves the right to suspend or terminate any account at any time without notice or explanation.
