Vehicle Operation. The Lessee shall ensure that only properly trained and licensed drivers operate the leased vehicle(s). The Lessee shall provide the Lessor with the names of all individuals whom it authorizes to operate the vehicle(s), and shall provide the name of each before said individual may operate the vehicle(s). The leased vehicle(s) shall not be used in violation of any federal, state or municipal statutes, laws, ordinances, rules or regulations. The Lessee shall not use any leased vehicle, nor allow any such vehicle to be used, for any unlawful purpose or for the transportation of any property or material deemed hazardous. Respirators, concentrators, or portable oxygen used by individuals are not considered hazardous materials. The Lessee shall operate the leased vehicle(s) only on designated roads, and shall not subject the vehicle(s) to use under such road conditions as may result in damage to the vehicle(s).
Vehicle Operation. Consignor hereby authorizes consignee its employee(s) agents or any prospective buyer to demonstrate and operate the vehicle.
Vehicle Operation. 49.1 All Employees who operate an Employer-owned vehicle are expected to follow all rules and regulations and responsibilities as established under the Motor Carrier Act (Nova Scotia), Motor Vehicle Act, (Nova Scotia) and Education Act and/or Regulations (Nova Scotia).
Vehicle Operation. EMPLOYEE shall operate any vehicle used in connection with the performance of her duties in a safe manner and otherwise in reasonable observance of all established traffic safety laws and ordinances and shall maintain a valid California automobile's driver's license during the period of employment. In addition, EMPLOYEE shall maintain in full force and effect during the Term of this Agreement, valid automobile liability insurance providing coverage for collision, personal injury and medical reimbursement, in accordance with the CITY'S Administrative Policy.
Vehicle Operation. XxXXXXXX shall operate any vehicle used in connection with the performance of his duties as City Manager in a safe manner and otherwise in observance of all established traffic safety laws and ordinances and shall maintain a valid California automobile's driver's license during the period of employment. In addition, XxXXXXXX shall maintain in full force and effect during the Term of this Agreement, valid automobile liability insurance providing coverage for collision, personal injury and medical reimbursement, in accordance with the City's Administrative Policy.
Vehicle Operation. Lessee shall maintain and operate the Vehicle in strict conformity with all applicable provisions of law and shall not permit the Vehicle to be used to transport goods or passengers for hire. Lessee shall comply and shall cause all persons operating the Vehicle to comply with all provisions of law applicable to the Vehicle’s registration, leasing, insurance, use and operation, and with all condition of the Vehicle’s insurance, and shall prepare and furnish to Lessor all documents required there under. Lessee agrees that whenever any provision of law requires installation of any accessories or equipment. Lessee will comply with all such requirements and will accept and pay for such equipment when the vehicle is acquired for Lessee. Lessee shall be solely responsible for fines and penalties for violations of any provision of law, including but not limited to parking ordinances, arising out of the Vehicle’s use and/or operation. If the Vehicle is used for purposes not permitted by the Agreement (i) Lessee will reimburse Lessor for all damages sustained by Lessor as a result of such misuse, including, without limitation, Lessor’s liability for or payment of any fines which may be imposed on Lessor or paid on behalf of Lessee by Lessor and (ii) Lessor may at its option terminate this Agreement. Lessee shall not mortgage or otherwise encumber Lessee’s interest in the Vehicle or this Lease, or place the Vehicle in the possession of any person other than Lessee, its agents and employees, and members of the immediate family of such persons, each of whom must possess a valid driver’s license. The possession of the Vehicle by an unauthorized person shall be at the sole risk and responsibility of Lessee, and Lessee shall, at Lessor’s option, be considered in breach of this Agreement.
Vehicle Operation. All vehicles assigned to the Grounds and Trucking Division, including, but not limited to, dump trucks and pickup trucks with or without snowplows, will be operated by Grounds and Trucking employees only.
Vehicle Operation. Resident shall not operate a vehicle on the Property in a reckless manner that poses a threat to the safety of others or their property. Resident shall not operate a vehicle on the Property while under the influence of alcohol or while otherwise impaired. Operation of a vehicle on the Property in a reckless, intoxicated, or impaired manner shall be considered a material breach of this Lease Agreement.
Vehicle Operation. It is the business of ParaCruz to provide accessible transportation for people who are unable to independently negotiate the fixed route system due to a disability and METRO needs to do so in the context of federal and state laws and its contractual obligations. Having a stable work force is in the interest of the Union and METRO. No employee shall have their employment terminated or their regular hours of service reduced or conditions of employment adversely affected by METRO as a result of its contracting with common carriers or competitive bidding for operation of METRO equipment in service, nor as a result of the subcontracting of paratransit services. If new technologies such as automated vehicles and micro-transit vehicles operating as part of METRO’s service is considered for implementation, METRO agrees to meet and bargain with SMART over that implementation and the effect of that implementation. A minimum of seventy-five percent (75%) of all monthly ParaCruz trips will be performed by METRO employees covered by this agreement. The remaining ParaCruz trips may be performed by other parties or outside vendors using a combination of METRO and non-METRO vehicles. It is mutually understood by the parties that ParaCruz service, as detailed by the Americans with Disabilities Act (ADA), is a no default service under Federal Law. Management reserves the right using whatever means necessary, to ensure that METRO complies with Federal Law. METRO taxi-type equipment or paratransit equipment shall not be used in fixed route service. The use of METRO equipment operated by METRO shall not result in the replacement of fixed route service of Santa Xxxx Metropolitan Transit District with dial-a-ride or demand response service for the general public.
