Common use of Vehicle Parking Clause in Contracts

Vehicle Parking. Lessee shall be entitled to employee and customer vehicle parking, unreserved and unassigned, on those portions of the Common Areas designated by Lessor for parking. Common area parking shall be used only for parking by vehicles no larger than full-size passenger automobiles or pick-up trucks, herein called “Permitted Size Vehicles.” Vehicles other than Permitted Size Vehicles, including semi cabs and trailers, are herein referred to as “Oversized Vehicles.” At no additional cost to Lessee, Lessor shall allocate forty-seven (47) parking spaces for Lessee’s non-exclusive use during the Term of the Lease which shall include including extensions (“Lessee Parking Spaces”). Six (6) of the Lessee Parking Spaces shall be located within the Common Area adjacent to the Premises and designated as “visitor/customer parking” with signage provided by Lessor. In the event of a shortage of parking spaces as determined in the reasonable discretion of Lessor, Lessor will create for Lessee’s non-exclusive use, sixteen (16) additional parking spaces along the south drive aisle as depicted on Exhibit B attached hereto. At no time without Lessee’s written consent shall Lessor stripe additional parking in a location that materially limits Lessee’s convenient access to Lessee’s loading docks or drive-in doors. (a) Lessee shall not permit or allow any vehicles that belong to or are controlled by Lessee or Lessee’s employees, suppliers, shippers, customers, or invitees to be loaded, unloaded, or parked in areas other than those designated by Lessor for such activities. (b) Lessee shall not permit or allow overnight parking or storage of Oversized Vehicles anywhere within the Industrial Center. In the event that Lessor is required to conduct snow removal, parking lot maintenance or Building maintenance, Lessor requires that all vehicles be removed from the affected areas within the parking areas. (c) If Lessee permits or allows any of the prohibited activities described in paragraph 2.2 of this Lease, then Lessor shall have the right, without notice, in addition to such other rights and remedies that it may have, to remove or tow away the vehicle involved and charge the cost to Lessee, which cost shall be immediately payable upon demand by Lessor.

Vehicle Parking. Six (6) Tenant's employees, invitees, suppliers, or others, in any portion of the Lessee Parking Spaces shall be located within the Common Area adjacent to the Premises and not designated as “visitor/customer parking” with signage provided by LessorLandlord for such use by Tenant. In the event of a shortage of parking spaces as determined in the reasonable discretion of Lessor, Lessor will create for Lessee’s non-exclusive use, sixteen (16) additional parking spaces along the south drive aisle as depicted on Exhibit B attached hereto. (a) Lessee Tenant shall not permit abandon any inoperative vehicles or allow equipment on any vehicles that belong to or are controlled by Lessee or Lessee’s portion of the Common Area, nor shall Tenant, its employees, suppliersinvitees, shipperssuppliers or others park or store any vehicle (Permitted Size or otherwise) on any portion of the Common Area, customers, or invitees to be loaded, unloaded, or parked in areas other than those including designated by Lessor for such activities. (b) Lessee shall not permit or allow overnight parking or storage of Oversized Vehicles anywhere within the Industrial Center. In the event that Lessor is required to conduct snow removal, parking lot maintenance or Building maintenance, Lessor requires that all vehicles be removed from the affected areas within the parking areas. , unattended for any period longer than twenty-four (c24) hours. If Lessee Tenant commits, permits or allows any of the prohibited activities described in paragraph 2.2 of this Leasethe Lease or the rules then in effect, then Lessor Landlord shall have the right, without notice, in addition to such other rights and remedies that it may have, to remove or tow 2 away the vehicle involved and charge the cost to LesseeTenant, which cost shall be immediately payable paid by Tenant to Landlord upon demand by Lessorfrom Landlord.

Landlord may allocate and assign parking spaces among Tenant and other tenants in the Project if Landlord reasonably determines that such parking facilities are becoming crowded. Landlord shall not be responsible for enforcing Tenant’s parking rights against any third parties. In the event of a shortage of parking spaces as determined in the reasonable discretion of Lessor, Lessor will create for Lessee’s non-exclusive use, sixteen (16) additional parking spaces along the south drive aisle as depicted on Exhibit B attached hereto. At no time without Lessee’s written consent shall Lessor stripe additional parking in a location that materially limits Lessee’s convenient access to Lessee’s loading docks or drive-in doors.addition: (a1) Lessee Tenant shall not permit or allow any vehicles that belong to or are controlled by Lessee Tenant or LesseeTenant’s employees, suppliers, shippers, customers, contractors or invitees to be loaded, unloaded, or parked in areas other than those designated by Lessor Landlord for such activities. (b2) Lessee Tenant shall not permit service or allow overnight parking or storage of Oversized Vehicles anywhere within store any vehicles in the Industrial Center. In the event that Lessor is required to conduct snow removal, parking lot maintenance or Building maintenance, Lessor requires that all vehicles be removed from the affected areas within the parking areasCommon Areas. (c3) Tenant shall not park any vehicles overnight in the Parking Spaces, the Common Areas, or anywhere else in the Project. (4) If Lessee Tenant permits or allows any of the prohibited activities described in paragraph 2.2 of this LeaseSection, then Lessor Landlord shall have the right, without notice, in addition to such other rights and remedies that it may have, to remove or tow away the vehicle involved and charge the cost to LesseeTenant, which cost shall be immediately payable upon demand by LessorLandlord.

Vehicle Parking. Lessee Tenant shall be entitled to employee and customer one hundred twenty- --------------- seven (127) vehicle parkingparking spaces, unreserved and unassigned, on those portions of the Common Areas designated by Lessor Landlord for parking. Common area Tenant shall not use more parking spaces than said number. Said parking spaces shall be used only for parking by vehicles no larger than full-full size passenger automobiles automobiles, SUV's, or pick-up trucks, herein called “"Permitted Size Vehicles.” " Vehicles other than Permitted Size Vehicles, including semi cabs and trailers, Vehicles are herein referred to as “"Oversized Vehicles.” At no additional cost to Lessee, Lessor shall allocate forty-seven (47) parking spaces for Lessee’s non-exclusive use during the Term of the Lease which shall include including extensions (“Lessee Parking Spaces”). (a) Lessee 2.2.1 Tenant shall not permit or allow any vehicles that belong to or are controlled by Lessee Tenant or Lessee’s Tenant's employees, suppliers, shippers, customers, contractors, or invitees to be loaded, unloaded, or parked in areas other than those designated by Lessor Landlord for such activities. (b) Lessee shall not permit or allow overnight parking or storage of Oversized Vehicles anywhere within the Industrial Center. In the event that Lessor is required to conduct snow removal, parking lot maintenance or Building maintenance, Lessor requires that all vehicles be removed from the affected areas within the parking areas. (c) 2.2.2 If Lessee Tenant permits or allows any of the prohibited activities described in paragraph 2.2 of this LeaseLease and such prohibited --- activities do not cease within 24 hours after notice from Landlord, then Lessor Landlord shall have the right, without notice, in addition to such other rights and remedies that it may have, to remove or tow away the vehicle involved and charge the cost to LesseeTenant, which cost shall be immediately payable upon demand by LessorLandlord. Notwithstanding the foregoing, Landlord may exercise the rights provided for in paragraph 2.2.2 without prior notice to Tenant in the event of an emergency or ----- in the event that such violations shall occur on more than one occasion within the prior twelve (12) months, whether or not such prior violation was cured within 24 hours after Landlord's notice.

Vehicle Parking. (c) If Lessee permits or allows any of the prohibited activities described in paragraph 2.2 of this LeaseParagraph 2.6, then Lessor shall have the right, without notice, in addition to such other rights and remedies that it may have, to remove or tow away the vehicle involved and charge the cost to Lessee, which cost shall be immediately payable upon demand by Lessor. (d) To avoid conflicts with neighboring tenants at the Premises, Lessor requires that Lessee use its best efforts to communicate with neighbors on timing of large shipments, and furthermore recommends that these shipments are made during off-hours.

Vehicle Parking. Lessee 5.1 Tenant shall be entitled to employee and customer not morethatits Proportionate Share (as defined above) of vehicle parking, unreserved and parking spaces located onthefront sideofthePremises,unreservedand unassigned, on those portions of the Common Areas designated by Lessor Landlord from time to time for parking. Common area Said parking spaces shall be used only for parking by vehicles no larger than full-full size passenger automobiles or pick-up trucks, herein called “"Permitted Size Vehicles.” Vehicles "Vehicles other than Permitted Size Vehicles, including semi cabs and trailers, Vehicles are herein referred to as “"Oversized Vehicles.” At no additional cost "Tenant may utilize their dock-well only for purposes of parking any Oversized Vehicle. At no time any other tenant without Lessee’s Tenant's prior written consent shall Lessor stripe additional parking in a location that materially limits Lessee’s convenient access to Lessee’s loading docks or drive-in doorsconsent. (a) Lessee Tenant shall not permit or allow any vehicles that belong to or are controlled by Lessee Tenant or Lessee’s Tenant's employees, suppliers, shippers, Agents, customers, or invitees to be loaded, unloaded, or parked in areas other than those designated by Lessor Landlord for such activities, which are set forth on Exhibit "A" attached hereto. (b) Lessee shall not permit or allow overnight parking or storage of Oversized Vehicles anywhere within the Industrial Center. In the event that Lessor is required to conduct snow removal, parking lot maintenance or Building maintenance, Lessor requires that all vehicles be removed from the affected areas within the parking areas. (c) If Lessee Tenant permits or allows any of the prohibited activities described in paragraph 2.2 of this LeaseArticle V, then Lessor Landlord shall have the right, right without notice, in addition to such other rights and remedies that it may have, have to remove or tow away the vehicle involved and charge the cost to LesseeTenant, which cost shall be immediately payable upon demand by Lessorof Landlord, and be deemed to be additional rent.

Vehicle Parking. Lessee Tenant shall be entitled to employee use the number of Unreserved Parking Spaces and customer vehicle parking, unreserved and unassigned, Reserved Parking Spaces Specified in Paragraph 1.2(b) on those portions of the Common Areas designated from time to time by Lessor Landlord for parking. Common area Tenant shall not use more parking spaces than said number. Said parking spaces shall be used only for parking by vehicles no larger than full-size passenger automobiles or pick-up trucks, herein called “Permitted Size Vehicles"PERMITTED SIZE VEHICLES.” " Vehicles other than Permitted Size Vehicles, including semi cabs and trailers, are herein referred to as “Oversized Vehicles.” At no additional cost to Lessee, Lessor shall allocate forty-seven (47) parking spaces for Lessee’s non-exclusive use during the Term of the Lease which shall include including extensions (“Lessee Parking Spaces”). Six (6) of the Lessee Parking Spaces Vehicles shall be located within the Common Area adjacent to the Premises parked and designated loaded or unloaded as “visitor/customer parking” with signage provided directed by Lessor. In the event of a shortage of parking spaces as determined Landlord in the reasonable discretion of Lessor, Lessor will create for Lessee’s non-exclusive use, sixteen Rules and Regulations (16as defined in Paragraph 40) additional parking spaces along the south drive aisle as depicted on Exhibit B attached heretoissued by Landlord. At no time without Lessee’s written consent shall Lessor stripe additional parking in a location that materially limits Lessee’s convenient access to Lessee’s loading docks or drive-in doors(Also see Paragraph 2. (a) Lessee Tenant shall not permit or allow any vehicles that belong to or are controlled by Lessee Tenant or Lessee’s Tenant's employees, suppliers, shippers, customers, contractors or invitees to be loaded, unloaded, or parked in areas other than those designated by Lessor Landlord for such activities. (b) Lessee shall not permit or allow overnight parking or storage of Oversized Vehicles anywhere within the Industrial Center. In the event that Lessor is required to conduct snow removal, parking lot maintenance or Building maintenance, Lessor requires that all vehicles be removed from the affected areas within the parking areas. (c) If Lessee Tenant permits or allows any of the prohibited activities described in paragraph 2.2 of this LeaseParagraph 2.6, then Lessor Landlord shall have the right, without notice, in addition to such other rights and remedies that it may have, to remove or tow away the vehicle involved and charge the cost to LesseeTenant, which cost shall be immediately payable upon demand by LessorLandlord. (c) Landlord shall at the Commencement Date of this Lease, provide the parking facilities required by Applicable Law.

Vehicle Parking. Lessee Tenant shall be entitled to employee and customer vehicle parking, the non-exclusive use of unreserved and unassigned, unassigned parking spaces on those portions of the Common Areas Area designated by Lessor Landlord for parking. Common area In addition, subject to the rights of adjacent landowners and their tenants, invitees and customers under reciprocal parking agreements now or hereafter affecting the Project, Landlord shall provide for the following parking: (i) Tenant shall be entitled to two (2) parking spaces during the Term which shall be reserved to Tenant as against any other tenant in the Building during the hours from 7:30 a.m. through 5:00 p.m., Monday through Friday, the location of which shall be designated, from time to time, by Landlord, but which shall be as close to Tenant’s ATM as is reasonably practical taking into account the parking layout and the parking spaces already reserved to other tenants of the Project; and (ii) Landlord shall provide a minimum of eight (8) parking spaces designated as “Customer Parking” which shall be reserved to customers and visitors of the Project as against any other tenant in the Building during the hours from 7:30 a.m. through 5:00 p.m., Monday through Friday, the location of which shall be designated, from time to time, by Landlord, but which shall be as close to the front entrance to the Building as is reasonably practical taking into account the parking layout and the parking spaces already reserved to other tenants of the Project. A copy of the current reciprocal parking agreements are attached as Exhibit “D” hereto. All parking spaces shall be used only for parking by vehicles no larger than full-full size passenger automobiles or pick-up trucks, herein called “Permitted Size Vehicles.” ”. Common area Sublessee shall not use more parking spaces than said number. Said parking spaces shall be used only for parking by vehicles no larger than full-size passenger automobiles or pick-up pickup trucks, herein called “"Permitted Size Vehicles.” Vehicles " Sublessor may regulate the loading and unloading of vehicles by adopting Rules and Regulations as provided in Paragraph 2.9. (b) Lessee Sublessee shall not permit service or allow overnight parking or storage of Oversized Vehicles anywhere within store any vehicles in the Industrial Center. In the event that Lessor is required to conduct snow removal, parking lot maintenance or Building maintenance, Lessor requires that all vehicles be removed from the affected areas within the parking areasCommon Areas. (c) If Lessee Sublessee permits or allows any of the prohibited activities described in paragraph 2.2 of this LeaseParagraph 2.6, then Lessor Sublessor shall have the right, without notice, in addition to such other rights and remedies that it may have, to remove or tow away the vehicle involved and charge the cost to LesseeSublessee, which cost shall be immediately payable upon demand by Lessor.Sublessor. 2.7 Common Areas - Definition. The term "Common Areas" is defined as all areas and facilities outside the Premises and within the exterior boundary line of the Project and interior utility raceways and installations within the Premises that are provided and designated by the Sublessor from time to time for the general nonexclusive use of Sublessor, Sublessee and other tenants of the Project and their respective employees, suppliers, shippers, customers, contractors and invitees, including parking areas, loading and unloading areas, trash areas, roofs, roadways, walkways, driveways and landscaped areas and is to include all "Common Areas" as such term is defined in that certain Standard Industrial/Commercial Multi-Tenant Lease Modified Net 3 of 12 4828-5664-5711.v4

Vehicle Parking. Lessee So long as Tenant is not in default, and subject to the parking rules and regulations included herein, and as established by City from time to time, Tenant shall be entitled to employee use in common with other tenants City licensees, and customer vehicle parking, unreserved and unassigned, on those portions of authorized use by the Common Areas designated by Lessor for parking. Common area public one parking shall be used only for parking by vehicles no larger than full-size passenger automobiles or pick-up trucks, herein called “Permitted Size Vehicles.” Vehicles other than Permitted Size Vehicles, including semi cabs and trailers, are herein referred to as “Oversized Vehicles.” At no additional cost to Lessee, Lessor shall allocate forty-seven (47) parking spaces for Lessee’s non-exclusive use during the Term of the Lease which shall include including extensions (“Lessee Parking Spaces”). Six (6) of the Lessee Parking Spaces shall be located within the Common Area space adjacent to the Premises and designated as “visitor/customer parking” with signage provided by LessorPremises, on Xxxxx Xxxxxxx Place. In the event of a shortage of parking spaces as determined in the reasonable discretion of Lessor, Lessor will create for Lessee’s non-exclusive use, sixteen Tenant shall lease seven (167) additional parking spaces along the south drive aisle as depicted on Exhibit B attached hereto. At no time without Lessee’s written consent shall Lessor stripe additional parking in a location that materially limits Lessee’s convenient access to Lessee’s loading docks or drive-in doorsat $14 per space per month. (a1) Lessee Unless otherwise instructed, every person using the parking area is required to park and lock his own vehicle. City will not be responsible for any damage to vehicles, injury to persons or loss of property, all of which risks are assumed by the party using the parking area. Tenant shall not permit or allow any vehicles that belong post and distribute sufficient references to or are controlled by Lessee or Lessee’s employees, suppliers, shippers, customers, or invitees these conditions of use as necessary to be loaded, unloaded, or parked in areas other than those designated by Lessor for such activitiesprovide reasonable notice. (b2) Lessee Tenant shall not permit or allow overnight parking or storage of Oversized Vehicles anywhere within the Industrial Center. In the event that Lessor is required to conduct snow removal, parking lot maintenance or Building maintenance, Lessor requires be responsible for ensuring that all vehicles be removed from of its employees, agents, and invitees comply with the affected areas within the applicable parking areas. (c) requirements, laws and agreements. If Lessee Tenant commits, permits or allows any of the prohibited activities described in paragraph 2.2 this Article 2, or other violation of this Leasethese rules, then Lessor City shall have the right, right without notice, in addition to such other rights and remedies that it may have, to remove or tow away the vehicle involved and charge the cost to LesseeTenant, which cost shall be immediately payable upon demand by LessorCity. Tenant shall post reasonable notice of such provision. (3) All parking use shall be subject to the following rules: (a) Tenant shall not park or store motor homes, campers, trailers, non- operational vehicles, boats or any vehicle not directly related to Tenant’s activities on the Premises. (b) Tenant shall not permit or allow any vehicles that belong to or are controlled by Tenant or Tenant’s employees, suppliers, shippers, customers, or invitees to be loaded, unloaded, or parked in areas other than those designated by City for that particular activity. (c) Users of the parking area will observe all posted signs and park only in the areas designated for vehicle parking. (d) The maintenance, washing, waxing or cleaning of vehicles on the Premises is prohibited. City reserves the right to modify these requirements and/or adopt such other reasonable requirements as the Airport Director may determine to be necessary for the proper operation of the parking area and the Airport. City reserves the right to relocate all or a part of parking spaces to other Airport property upon thirty (30) days advance written notice.
