Common use of Victims of Crime Clause in Contracts

Victims of Crime. If an employee, an immediate family member, domestic partner, or the employee’s domestic partner’s child is a victim of a violent or serious felony as defined by the Penal Code or felony theft or embezzlement, the employee may take unpaid time off from work in order to attend judicial proceedings related to that crime. When feasible, prior to taking time off, the employee must supply a copy of the notice of each scheduled proceeding provided to the victim. When advance notice is not feasible or an unscheduled absence occurs, the employee may, within a reasonable amount of time provide documentation evidencing the judicial proceeding from any of the following entities: 1) The court or government agency setting the hearing; 2) The district attorney or prosecuting attorney’s office, or; 3) The victim/witness office that is advocating on behalf of the victim. If appropriate certification is provided within a reasonable time, the absence will not be counted as an unscheduled absence. The employee may use accrued vacation, compensatory time off, or holiday leave.
