In the event that any assessment, fee or charge which is applicable to the Property is subject to Article XIIID of the California Constitution and OWNER does not return its ballot, OWNER agrees, on behalf of itself and its successors that the County may count OWNER’s ballot as affirmatively voting in favor of such assessment, fee or charge.
