CONTRACT LIMIT AND FEES AND EXPENSES to change the not-to- exceed total amount of the Contract from SIX HUNDRED THOUSAND DOLLARS AND NO CENTS ($600,000.00) to ONE MILLION DOLLARS AND NO CENTS ($1,000,000.00) through the end of the first renewal term of the Contract, as approved by RRC Commissioners on September 18, 2018.

CONTRACT LIMIT AND FEES AND EXPENSES changing the not-to-exceed amount of the Contract from ONE MILLION DOLLARS AND ZERO CENTS ($1,000,000.00) to SIX MILLION DOLLARS AND ZERO CENTS ($6,000,000.00) through the first renewal term of the Contract as approved by RRC Commissioners August 21, 2018; and to add sections 7.07. PROHIBITION ON CONTRACTING WITH COMPANIES THAT BOYCOTT ISRAEL, and 7.08. PROHIBITION ON CONTRACTING WITH COMPANIES ENGAGED IN BUSINESS WITH FOREIGN TERRORIST ORGANIZATIONS; and to modify section 7.07. EXECUTION SIGNATURES. to be EXECUTION SIGNATURES.; and

CONTRACT LIMIT AND FEES AND EXPENSES is deleted in its entirety and replaced with the following: “CONTRACT LIMIT, FEES AND EXPENSES. The total amount of fees to be paid by RRC to Contractor under the Contract through the Contract Term shall not exceed EIGHT MILLION FIFTY THOUSAND DOLLARS AND ZERO CENTS ($8,050,000.00), the total of which includes the current NTE amount of FIVE MILLION, SEVEN HUNDRED AND FIFTY THOUSAND DOLLARS AND ZERO CENTS ($5,750,000.00), as approved by RRC Commissioners on September 1, 2020, plus the addition of TWO MILLION THREE HUNDRED THOUSAND DOLLARS AND ZERO CENTS ($2,300,000.00), as approved by RRC Commissioners on August 24, 2021.” Except as expressly amended above, all provisions of the Contract, as amended, remain in full force and effect. In the event of a conflict among provisions of the Contract, the order of precedence shall be: this Amendment No. 2; and then Amendment No. 1; and then the original Contract in accordance with section 1.03. ORDER OF PRECEDENCE., therein.

The total amount of fees to be paid by RRC to Contractor under the Contract through the Contract Term shall not exceed SIX HUNDRED TWENTY-FIVE THOUSAND DOLLARS AND ZERO CENTS ($625,000.00), the total of which includes the current NTE amount of FIVE HUNDRED FIFTY THOUSAND DOLLARS AND ZERO CENTS ($550,000.00), as approved by the Executive Director on August 26, 2021, plus the addition of SEVENTY-FIVE THOUSAND DOLLARS AND ZERO CENTS ($75,000.00), as approved by the Executive Director effective as of the date executed by the parties in Amendment No.2.” Except as expressly amended above, all provisions of the Contract, as amended, remain in full force and effect. CONTRACT LIMIT AND FEES AND EXPENSES changing the not-to-exceed amount of the Contract from FIVE MILLION DOLLARS AND ZERO CENTS ($5,000,000.00) to NINE MILLION DOLLARS AND ZERO CENTS ($9,000,000.00) through the end of the second renewal term of the Contract as approved by RRC Commissioners on August 21, 2018; and

The total amount of fees to be paid by RRC to Contractor under the Contract through the Contract Term shall not exceed NINE HUNDRED FIFTY THOUSAND DOLLARS AND ZERO CENTS ($950,000.00), the total of which includes the current NTE amount of EIGHT HUNDRED FIFTY THOUSAND DOLLARS AND ZERO CENTS ($850,000.00) plus the addition of ONE HUNDRED THOUSAND DOLLAR AND ZERO CENTS ($100,000.00), as approved by the Executive Director effective as of the date executed by the parties in Amendment No.3.”
