Voting arrangements of the Performance Assurance Committee. 16.5.1 The discharge of all of the functions of the Performance Assurance Committee which require or allow for a determination of the Performance Assurance Committee shall be determined by a vote conducted on a show of hands or other such demonstration of affirmation or consent as may be appropriate; and each PAC Representative (whether in person or by its alternate) present at the meeting shall be entitled to exercise one (1) vote. 16.5.2 A decision of the Performance Assurance Committee shall require a simple majority of the votes of both: (a) the Shipper User Representatives; and (b) the Transporter Representatives who in each case are present at the relevant meeting and who vote in respect of the matter to be decided; and in the event a simple majority is not obtained amongst the Shipper User Representatives or the Transporter Representatives the Performance Assurance Committee shall be treated as having made a decision against the relevant matter.
