Voting Classes Sample Clauses
Voting Classes. For purposes of voting, there shall be two classes of GAIN POC Members (“Voting Classes”): (a) OIDF GAIN POC Members, and (b) Other GAIN POC Members. The following shall be the requirements for inclusion in each voting class:
Voting Classes. Classes 4 and 5 are Impaired under this Plan. The Holders of Claims in such Classes as of the Voting Record Date are entitled to vote to accept or reject this Plan.
Voting Classes. Classes 5 and 6 are Impaired under the Plan and are entitled to vote to accept or reject the Plan.
Voting Classes. Claims in Class 3 are Impaired under this Plan and the Holders of Allowed Claims in such Class are entitled to vote to accept or reject this Plan, including by acting through a voting Representative. For purposes of determining acceptance and rejection of this Plan, votes shall be tabulated on a Debtor-by-Debtor basis. Pursuant to section 1126(c) of the Bankruptcy Code, an Impaired Class of Claims shall have accepted this Plan if (a) the Holders, including Holders acting through a voting Representative, of at least two-thirds (2/3) in amount of Claims actually voting in such Class have voted to accept this Plan and (b) the Holders, including Holders acting through a voting Representative, of more than one-half (1/2) in number of Claims actually voting in such Class have voted to accept this Plan. Holders of Claims in Class 3 (or, if applicable, the voting Representatives of such Holders) shall receive ballots containing detailed voting instructions. For the avoidance of doubt, each Claim in any Class entitled to vote to accept or reject this Plan that is not Allowed pursuant to this Plan, and in each case, is wholly contingent, unliquidated, or Disputed, in each case, shall be accorded one (1) vote and valued at one dollar ($1.00) for voting purposes only, and not for purposes of allowance or distribution.
Voting Classes. Each Holder of an Allowed Claim in Class 3 shall be entitled to vote to accept or reject the Debtor’s Plan.
Voting Classes. Classes 3, 4 and 5A are Impaired and entitled to vote to accept or reject the Plan. Prior to the Petition Date, the Debtors solicited acceptance of the Plan from the Holders of Claims in such Classes. Upon the conclusion of such solicitation efforts, at least one of these Impaired voting Classes has elected to accept the Plan.
Voting Classes. The Association shall initially have two classes of voting membership:
Class A. Class A members shall be all Owners with the exception of the Declarant (except as here- inafter provided) and shall be entitled to one vote for each Lot owned; provided, however, if there is more than one Residential Unit placed on Lots 1, 20 and 21, such Residential Unit Owners shall be entitled to _ vote for each Residential Unit owned. When more than one person owns an interest in any Lot, all such persons shall be members. The vote of such Lot shall be exercised as the persons among themselves determine, but in no event shall more than one vote be cast with respect to each Lot or one-half vote as provided in the preceding sentence.
Class B. The Class B member shall be the Declarant and shall be entitled to three (3) votes for each Lot or Commercial Unit owned. Class B membership shall cease and be converted to Class A mem- bership on the earlier of the following dates:
(a) the date on which the total outstanding votes in the Class A membership equal or exceed the total available votes in the sum of Class B memberships; or
(b) January 1, 2003.
