Waiver Approval. The School shall, within 30 days from the execution of this Contract, deliver to the NMPED any Discretionary Waiver requests submitted for the Secretary’s approval. The NMPED shall notify the School of the Secretary’s decision on the Discretionary Waiver(s). The School shall ensure that Exhibit 2 correctly identifies the waiver(s) approved by the Secretary.
Waiver Approval. The party receiving the request for a waiver will respond in writing within 20 calendar days. The waiver does not become effective until the waiver is approved in writing by the Association and the Governing Board.
Waiver Approval. If the waiver involves an adjustment to a collective agreement, the waiver does not become effective until the adjustment is approved in writing by CETA and the Board. If the waiver involves a change in Board Policy, the Board must approve. If the waiver involves an alteration of Central Services, the Superintendent must approve. If the waiver involves the Education Code, the established procedure for Education Code waivers will be utilized.
Waiver Approval. This Agreement shall not be amended, modified or supplemented without the written agreement of Borrower and the Lender at the time of such amendment, modification or supplement. No waiver of any provision of this Agreement shall be effective unless set forth in writing signed by the party making such waiver, and any such waiver shall be effective only to the extent therein set forth. Failure by the Lender to insist upon full and prompt performance of any provisions of this Agreement, or to take action upon the occurrence of any Event of Default, shall not constitute a waiver of any rights of the Lender, and the Lender may at any time thereafter exercise all available rights and remedies with respect to such Event of Default. Receipt by the Lender of any instrument or document shall not constitute or be deemed to be an approval thereof.
Waiver Approval. (1) A waiver re- quest is deemed approved if CMS fails to act on the request within 90 days after the date the waiver request is re- ceived by CMS.
(2) CMS may withdraw approval of a waiver for good cause. [67 FR 61505, Oct. 1, 2002, as amended at 71 FR 71334, Dec. 8, 2006]
(a) A PACE organization must have an agreement with CMS and the State administering agency for the operation of a PACE program by the PACE orga- nization under Medicare and Medicaid.
(b) The agreement must be signed by an authorized official of CMS, the PACE organization and the State ad- ministering agency.

Waiver Approval. Any Party to this Agreement may (a) extend the time for the performance of any of the obligations or other acts of the other Parties, (b) waive any inaccuracies in the representations and warranties of the other Party contained herein or in any document delivered by the other Parties pursuant hereto or (c) waive compliance with any of the agreements of the other Parties or conditions to such Parties’ obligations contained herein. Any such extension or waiver shall be valid only if set forth in an instrument in writing signed by the Party to be bound thereby. Any waiver of any term or condition shall not be construed as a waiver of any subsequent breach or a subsequent waiver of the same term or condition, or a waiver of any other term or condition of this Agreement. The failure of any Party hereto to assert any of its rights hereunder shall not constitute a waiver of any of such rights. Any waiver, approval or consent sought by one Party from another Party pursuant to this Agreement must be submitted only to those individuals listed in Section 10.02 of this Agreement, and no other Representative shall have the authority to bind a Party to such waiver, approval or consent except for such individuals listed in Section 10.02 of this Agreement and/or any designee identified by such individual(s) to the Parties of this Agreement in writing.
Waiver Approval. The Administrative Agent and the Lenders signatory hereto hereby consent to the December 2021 Dividend Waiver, the Investment Waiver and the Merger Waiver.
Waiver Approval. The Authorizer shall, within 30 days from the execution of this agreement, deliver to the NMPED any request by the School to be waived from NMPED rule or the Public School Code. If the request is denied, the NMPED shall notify the Authorizer and the School in writing of the denial and reasons. If denied, the School shall, within 30 days of the NMPED’s notice of denial, submit a proposed amendment to the Authorizer addressing the denied waiver, if necessary.
