Waiver of Disbursement Conditions. Lender may in its sole discretion waive any condition to the funding of a Disbursement. Any waiver of any condition to the funding must be expressly made and signed by an authorized officer of Lender. Lender shall not have made or be deemed to have made any waiver of any condition to the funding of any Disbursement as provided herein. The approval of any Draw Requests by Lender shall not constitute approval by Lender of any work, costs or expenses for which the Disbursement is made, or of any design, manufacturing, structural or other defect in any such work. The approval of any Disbursement prior to fulfillment of one or more conditions thereof shall not be construed as a waiver of any condition, and Lender reserves the right to require fulfillment of any and all conditions prior to approving any subsequent Disbursement.
