Common use of Waiver of Insurers Clause in Contracts

Waiver of Insurers. Each party shall cause each insurance policy (other than the commercial general liability insurance) required to be obtained by it pursuant to this Lease to provide that the insurer waives all rights of recovery by way of subrogation against either Landlord or Tenant, as the case may be, in connection with any claims, losses and damages covered by such policy. If either party fails to maintain any such insurance required hereunder, such insurance shall be deemed to be self-insured with a deemed full waiver of subrogation as set forth in the immediately preceding sentence.

Waiver of Insurers. Each party shall cause each property insurance policy (other than the commercial general liability insurance) required to be obtained by it pursuant to this Lease to provide that the insurer waives all rights of recovery by way of subrogation against either Landlord or Tenant, as the case may bebe (or agrees that the coverage under such policy shall not be invalidated by the waivers set forth in Section 22.1 above), in connection with any claims, losses and damages covered by such policy. If either policy or which would have been covered by such property insurance policy had such party fails obtained and maintained the insurance policy it was required to obtain and maintain any such insurance required hereunder, such insurance shall be deemed to be self-insured with a deemed full waiver of subrogation as set forth in the immediately preceding sentence(whichever is greater).
