Common use of Waiver of Property Claims Clause in Contracts

Waiver of Property Claims. All Xxxxxx Supplied Components and equipment used by Xxxxxx in the Production of Client Product (collectively, “Xxxxxx Property”) shall at all times remain the property of Xxxxxx. Xxxxxx assumes risk of loss for the Xxxxxx Property and for the Client Supplied Components and all other Client Information and Materials (upon delivery to Xxxxxx), and assumes risk of loss of Client Product until delivery of Client Product to a common carrier as specified under Section 2.5. Xxxxxx hereby waives any and all rights of recovery against Client and its Affiliates, and against any of their respective directors, officers, employees, agents or representatives, for any loss or damage to Xxxxxx Property. Client assumes all risk of loss for all Client Supplied Components and all other Client Information and Materials until delivery to Xxxxxx, and assumes risk of loss of all Client Product upon delivery to a common carrier as specified under Section 2.5.

Xxxxxx hereby waives any and all rights of recovery against Client and its Affiliates, and against any of their respective directors, officers, employees, agents or representatives, for any loss or damage to Xxxxxx Property. Client assumes all risk of loss for all Client Supplied Components and all other Client Information and Materials until delivery to Xxxxxx, and assumes risk of loss of all Client Product upon delivery to a common carrier as specified under Section 2.52.7.
