Common use of Waiver of Right to Trial Clause in Contracts

Waiver of Right to Trial. Notwithstanding any provision in the Guide to the contrary, with the exception of any legal action relating to the prevailing party’s enforcement of the Neutral’s Award, Freddie Mac and Seller/Servicer each hereby waive any and all rights each might possess to have the Dispute litigated in a state or federal court through bench or jury trial if all other terms in the Guide and the IDR Document regarding the IDR Process are satisfied.
