Warranties Exclusion of Warranties. (a) The Customer must look to the Manufacturer with regard to warranties relating to the Goods. Notwithstanding the foregoing, CHEP accepts liability for all warranties implied under applicable law, the effect of which cannot be excluded; provided, however, that as to CHEP all warranties and conditions that are capable of exclusion and would, apart from this provision, form part of these terms, are expressly excluded, and the Goods are sold on an AS IS, WHERE IS basis. Except where by law liability may not be limited or where a limitation of liability would otherwise render CHEP liable to a penalty, CHEP’s liability for breach of terms which cannot be excluded is limited to replacement or repair, at CHEP’s option of the Goods or payment of the costs of replacing or repairing the Goods.
