Common use of Warranty of Fitness of Equipment and Materials Clause in Contracts

Warranty of Fitness of Equipment and Materials. Contractor represents and warrants to the County that all equipment and materials used in the Work, and made a part of the Work, or placed permanently in the Work, shall be new unless otherwise specified in the Contract Documents. All equipment and materials used shall be of good quality, free of defects and in conformity with the Contract Documents. All equipment and materials not in conformity with the Contract Documents shall be considered defective.
