Common use of Warranty of Information Clause in Contracts

Warranty of Information. I represent and warrant that all data, information and documents provided or submitted by me pursuant to this Agreement, including the Customer Account Information Form (CAIF), are true, complete, current and accurate. I undertake to update all of my information/records, particularly those indicated in my CAIF and submit documents in support thereof, at least once every two (2) years or upon your request. In case of any change in said information, including but not limited to the change of my status from “non-U.S. Person” to “U.S. Person”, as defined under Foreign Account Tax Compliance Act (FATCA) of the United States of America, I shall immediately inform and furnish you with all necessary supporting documents. In the absence of any change, you shall consider all the information in my Account as current until I update them. I also hereby authorize you to conduct such credit or background checks to verify any information provided by me, and to ascertain my financial situation and investment objectives.
