Water Certificate. Purchaser shall issue to Seller a water certificate pursuant to Section 30-10-114(J) of the Berthoud Town Code, which certificate shall grant to Seller one (1) Single Family Equivalent water credit for each four tenths (0.4) AF per year of water changed and approved for the Purchaser’s municipal use in the Change Decree.

Water Certificate. In a school requiring the holder of a water certificate, the Chief shall possess such a certificate and will be paid an additional twenty cents per hour. For an employee who works less than hours per week, the evening shift allowance shall be paid on all hours worked after Any shift composed of seven (7) hours or more worked between and is to be classified as an evening shift, and any shift composed of seven (7) hours or more worked between and a.m. is to be classified as a night shift. No further nightshifts will be instituted unless school operations change significantly. If school operations do change significantly, night shifts will not be instituted without prior discussion and consultation with the Union. Shift differential shall be paid as follows: Evening shift (41 cents) -Three weeks or more (46 cents) Night shift (52 cents) People on alternate week shift will be paid cents per hour in addition to the regular hourly rate on all regular hours worked. People on three weeks evenings and one week days will be paid cents per hour in addition to the regular hourly rate on all regular hours worked. Employees will not be paid under both and Employees will not suffer a shift differential wage loss during the Christmas and March break, or for illnesses less than ten consecutive working days. Duringthe months of July and August, the shift differential rate will only apply to those staff working evening or night shifts. For purposes, during the months of July and August, the shift differential rate will cease with the first payroll of July, continue for pay periods, and be reinstated on the first payroll of September. Should an employee be required to be on standby the employee shall be paid hours per day hours) at straight time rates for each day hours) the employee is required to be on standby. Inthe event that the employee on standby is called in to work the employee shall be paid the appropriate overtime rate for the hours worked. If in the opinion of a supervisor a lead hand is required on a job the individual with the greater seniority and the qualifications who has expressed an interest in such a position will be selected and shall be paid per hour for the period of time for which the employee is assigned the responsibility of leadhand.

Water Certificate. In order to purchase City of Chicago Real Property Real Property Transfer Tax stamps (which are required to record the Deed), a water certification (i.e., a Full Payment Certificate [“FPC”] issued by the Department of Finance of the City of Chicago stating that all water and sewer charges and penalties that accrued to a water account are paid in full or otherwise not transferable to Purchaser) is required. Seller shall complete and deliver an FPC Application to the Department of Finance within five (5) business days following the Effective Date. However, Purchaser acknowledges that, despite Seller’s timely submission of an FPC application, due to a backlog of FPC applications, the FPC Certificate may not be issued by the Closing Date. The parties agree that, so long as Seller has timely submitted the FPC Application hereunder, and diligently follows up with the City, if Seller has not received an FPC Certification prior to Closing, then Seller shall not be in default hereunder due to the failure of the FPC Certificate to be issued and the Closing Date shall be delayed until the date that the FPC Certificate is obtained unless Seller, at its option, elects to deliver to the Title Company a water certification indemnity in order to allow the issuance of the Title Policy to Purchaser, in which case, the parties shall proceed with Closing on the scheduled Closing Date and shall obtain the FPC Certificate post-Closing.
Water Certificate. A full payment certificate issued by the City of Chicago Department of Finance certifying that all water and sewer charges and penalties, if any, accrued to the water accounts with respect to the Hotel Leases and Improvements, have been paid in full as of the Closing.

  • Provisional Certificate 12.2.1 Subject to the provisions of Clause 12.2.5, upon completion of all Works forming part of the Project Highway, save and except the Works for which Time Extension has been granted under Clause 10.5, the Authority’s Engineer shall, at the request of the Contractor, issue a provisional certificate of completion substantially in the form set forth in Schedule-L (the “Provisional Certificate”) if the Tests for and in respect of the completed Works are successful. The Provisional Certificate shall have appended thereto a list of outstanding items of work (the “Punch List”) that need to be completed in accordance with the provisions of this Agreement. The Contractor undertakes to complete the minor outstanding items of works in respect of those Sections of the Project Highway for which the Provisional Certificate has been issued, within a period of 30 (thirty) days of the date of Provisional Certificate, and those parts of the Works in respect of which Time Extension has been granted, within the extended period thereof. For the avoidance of doubt, the Parties agree that the Punch List shall include all Works for which Time Extension has been granted and shall also include any minor outstanding items of work forming part of the completed Sections if such works do not materially affect the use of the completed Sections for their intended purpose. The Parties further agree that Provisional Certificate shall not be issued if the completed Works can not be safely and reliably placed in service of the Users thereof. 12.2.2 Upon issue of Provisional Certificate, the provisions of Articles 14 and 17 shall apply to the completed parts of the Project Highway and the property and ownership of all such completed Works shall vest in the Authority. 12.2.3 If the Authority’s Engineer determines that the Project Highway or any completed part thereof does not conform to the provisions of this Agreement and cannot be safely and reliably placed in operation, it shall forthwith make a report in this behalf and send copies thereof to the Authority and the Contractor and withhold issuance of the Provisional Certificate until the Defects or deficiencies are rectified by the Contractor and Tests are successful in accordance with this Article 12. 12.2.4 Notwithstanding anything to the contrary contained in Clause 12.2.3, the Authority may, at any time after receiving a report from the Authority’s Engineer under that Xxxxxx, direct the Authority’s Engineer to issue a Provisional Certificate under Clause 12.2.1 and such direction shall be complied forthwith. 12.2.5 No Provisional Certificate shall be issued under the provisions of this Clause 12.2 until the Contractor has submitted valid claims for payment of at least 80% (eighty per cent) of the amount arrived at after reducing the lump sum price specified in Clause 19.1.1 by the amount attributable to works which have been withdrawn under the provisions of Clause 8.3.3. For the avoidance of doubt and by way of illustration, the Parties agree that if the Contract Price specified in Clause 19.1.1 is Rs. 105 cr. (Rs. one hundred and five crore) and the works withdrawn under Clause 8.3.3 have a value of Rs. 5 cr. (Rs. five crore), a Provisional Certificate shall not be issued until valid claims for payment of an amount of Rs. 80 cr. (Rs. eighty crore) have been submitted by the Contractor in accordance with the provisions of this Agreement. It is further agreed that all price adjustments made in pursuance of Clause 19.10 shall not be reckoned for computation of the claims for payments referred to in this Clause 12.2.5.

(xxxv) the aggregate of all Liquidation Loss Amounts on the Mortgage Loans since the Cut-off Date and whether a Cumulative Loss Test Violation has occurred since the prior Determination Date; (xxxvi) the Rolling Six Month Delinquency Rate, the Spread Rate, the Excess Spread Percentage, and the Rolling Three Month Excess Spread Percentage for the Payment Date; and (xxxvii) in the Servicing Certificates for the first and second Payment Dates, the number and Cut-off Date Asset Balance of Mortgage Loans for which the Mortgage Loan File was not delivered to the Indenture Trustee within 30 days of the Closing Date. The Indenture Trustee and the Owner Trustee shall conclusively rely upon the information contained in a Servicing Certificate for purposes of making distributions pursuant to Section 8.03 of the Indenture or distributions on the Transferor Certificates, shall have no duty to inquire into this information and shall have no liability in so relying. The format and content of the Servicing Certificate may be modified by the mutual agreement of the Master Servicer, the Indenture Trustee and the Credit Enhancer. The Master Servicer shall give notice of any changes to the Rating Agencies.
