WHAT IS NOT COVERED. (A) Products not originally covered by a manufacturer’s warranty; (B) Products with less than an original ninety (90) days manufacturer’s parts and labor limited warranty (C) Product repairs that should be covered by the manufacturer’s warranty or are a result of a recall, regardless of the manufacturer’s ability to pay for such repairs; (D) Cleaning; Periodic checkups; preventive maintenance; (E) Any and all pre-existing conditions that occur prior to the effective date of this Agreement and/or any product sold used or “AS-IS”, including but not limited to floor models, demonstrations models, etc.;
WHAT IS NOT COVERED. (A) Products without a manufacturer’s warranty; (B) Products with less than an original ninety (90) days manufacturer’s parts and labor limited warranty (C) Product repairs that should be covered by the manufacturer’s warranty or are a result of a recall, regardless of the manufacturer’s ability to pay for such repairs; (D) Cleaning; periodic checkups; preventive maintenance; (E) Any and all pre-existing conditions that occur prior to the effective date of this Agreement and/or any product sold used or “as is”, including but not limited to floor models without a manufacturer warranty, demonstrations models, etc.; (F) Parts or repairs due to normal wear and tear [unless otherwise specified or] unless tied to a failure, and items normally designed to be periodically replaced by You during the life of the product, including but not limited to [batteries], light bulbs, etc.; (G) Damage from abuse, misuse, mishandling, introduction of foreign objects into the Covered Product, unauthorized modifications or alterations to a Covered Product; failure to follow the manufacturer’s instructions for operation and care of the Covered Product; external causes of any kind, including third party actions; fire; theft; insects; animals; exposure to weather; windstorm; sand; dirt; hail; earthquake; flood; water; acts of God or consequential loss of any nature; (H) Loss or damage caused by invasion; rebellion; riot; strike; labor disturbance; lockout; or civil commotion; (I) Incidental, consequential or secondary damages or delay in rendering service under this Agreement; loss of use during the period that the Covered Product is at an authorized service center or awaiting parts; (J) Any product used in a commercial setting or rental basis unless You purchased a Commercial Plan]; [

WHAT IS NOT COVERED. Exclusion What You are not covered for
i) If at the Date of Loss, You, or anyone insured to drive the Insured Vehicle under the Comprehensive Motor Insurance is deemed to have been driving: • without a valid license; or • under the influence of alcohol illegally, recreational drugs or any medication that impairs your influence to drive; or • whilst disqualified.
ii) Where the Insured Vehicle is not covered by Comprehensive Motor Insurance at the time of the Total Loss or where the driver of the Insured Vehicle at the Date of Loss is not covered by Comprehensive Motor Insurance.
iii) Where the Insured Vehicle is covered under any type of Comprehensive Motor Insurance policy that is connected with the motor trade.
iv) Where the Comprehensive Motor Insurance provider has offered to repair the Insured Vehicle and You have requested the claim to be dealt with on a Total Loss basis.
v) If the Insured Vehicle is used for any of the excluded uses that appear in Section 3 - ELIGIBILITY.
vi) Any deductions made by the Comprehensive Motor Insurance provider for any damage not associated with the Total Loss claim.
vii) Any salvage value of the Insured Vehicle where You are not required to transfer the ownership of the Insured Vehicle to the Comprehensive Motor Insurance provider.
WHAT IS NOT COVERED. This Agreement does not cover: (a) Transfers to and from accounts which are not primarily established for personal, family or household purposes except for transfers originated by a Sole Proprietor;
WHAT IS NOT COVERED. 7.1 The service levels, service guarantees and any compensation payments will not apply if
(a) the failure by BT is due to the Communications Provider’s own network or equipment or any other network or equipment outside the BT Network; or
(b) the Communications Provider is in breach of any part of this Contract which relates to the provision of the Service to the relevant Site or in respect of the relevant Service BT suspends the Service or any part of it in accordance with this Contract; or
(c) through no fault of its own or because of circumstances beyond its reasonable control, BT is unable to carry out any necessary work at, or gain access to the Site or the Communications Provider fails to agree an appointment date or work is aborted due to the Communications Provider; or
(d) the Communications Provider and BT agree a different timescale in writing (which shall include e-mail) for performance of the relevant Service; or
(e) reasonable assistance is required or information is reasonably requested by BT within a reasonable timescale from the Communication Provider or the End User or a third party and such assistance or information is not provided; or
(f) through no fault of its own, BT is unable to obtain any necessary permissions or consents required in connection with the performance of a particular service level; or
(g) the failure is due to a Force Majeure event; or
(h) the failure is due to a planned outage on EMP, Emergency Service interruption or Scheduled Outage on EMP ; or
(i) the failure is due to an inaccurate Order being submitted by the Communications Provider and the Communications Provider has been informed by the end of the next Working Day; or
(j) if the fault is not reported in accordance with fault reporting provisions in Schedule 2 (paragraph 4) and the Communications Provider has been informed by the end of the next Working Day; or
(k) if the fault is due to a failure in the public internet Service Level Guarantees (SLGs) will not apply to the DFA Service for the period from soft launch and full launch of the DFA Service. During the intervening period BT will engage with CPs in good faith negotiations with respect to the SLGs that will apply from full launch. Compensation payments are marked as “TBA” in this Schedule 4(b) which will mean zero payments until the time of full launch. This Service Level Agreement is applicable to the DFA Service.
WHAT IS NOT COVERED. A. Any product fraudulently described or misrepresented by You;
B. Maintenance, repair, or replacement necessitated by loss or damage resulting from any cause other than normal use and operation of the product in accordance with the manufacturer’s specifications and owner’s manual, including but not limited to , theft or loss, exposure to weather conditions, failure to properly clean, maintain or lubricate, operator negligence, misuse, abuse, improper electrical/power supply, improper equipment modifications, attachments or installation or assembly, vandalism, animal or insect infestation, battery leakage, or act of nature or any other peril originating from outside the product.
C. Cosmetic damage to case or cabinetry or other non-operating parts or components which does not affect the functionality or the covered product.
D. Television or personal computer monitor screen imperfections, including “burn-in” or burned CRT phosphor.
E. Projector or rear projection TV bulbs unless that specific coverage has been offered and purchased at the time of sale with your Service Agreement.
F. Damaged or defective LCD screens when the failure is caused by abuse or is otherwise excluded herein;
G. All equipment intended for heavy commercial or industrial use such as industrial printers or IT equipment; riding mowers or back hoe type products;
H. Accidental or intentional damage, cracked or damaged monitor, laptop or display screens, liquid damage, lost buttons or knobs etc., unless optional accidental damage from handling (ADH) coverage was offered and purchased at the time of sale with your Service Agreement;
I. Conditions that were caused by You or known by You prior to purchasing this Service Agreement;
J. Consumer replaceable or consumable batteries unless that specific coverage has been offered and purchased at the time of sale with your Service Agreement;
K. Consumer replaceable or consumable items such as but not limited to toner, ribbons, ink cartridges, drums, belts, printer heads, belts, blades, strings, trim etc.;
L. Product(s) with removed or altered serial numbers;
M. Manufacturer defects or equipment failure which is covered by manufacturer’s warranty, manufacturer’s recall, or factory bulletins (regardless of whether or not the manufacturer is doing business as an ongoing enterprise);
N. Damage to computer hardware, software and data caused by, including, but not limited to, viruses, application programs, network drivers, source code, object code or propr...
WHAT IS NOT COVERED. A. PRODUCTS NOT ORIGINALLY COVERED BY A MANUFACTURER’S WARRANTY; B. ITEMS THAT ARE STILL COVERED BY THE MANUFACTURER’S WARRANTY, REGARDLESS OF WHETHER THE K. INCIDENTAL, CONSEQUENTIAL OR SECONDARY DAMAGES OR DELAY IN RENDERING SERVICE UNDER THIS AGREEMENT, OR LOSS OF USE DURING THE PERIOD THAT THE COVERED PRODUCT IS AT THE SERVICING DEALER FOR MANUFACTURER HONORS SUCH WARRANTY; REPAIR SERVICE OR OTHERWISE AWAITING PARTS;
C. PERIODIC CHECKUPS AND/OR PREVENTATIVE MAINTENANCE AS DIRECTED BY THE MANUFACTURER; L. ANY PRODUCT CURRENTLY OR PREVIOUSLY USED IN A COMMERCIAL SETTING OR RENTAL BASIS; D. INHERENT PRODUCT DEFECTS THAT ARE THE M. FAILURES THAT OCCUR OUTSIDE OF THE 50 STATES OF THE RESPONSIBILITY OF THE MANUFACTURER OR PARTS FAILURE DUE TO A MANUFACTURER’S RECALL; UNITED STATES OF AMERICA AND THE DISTRICT OF COLUMBIA; E. ANY AND ALL PRE-EXISTING CONDITIONS THAT OCCUR N. NONFUNCTIONAL OR AESTHETIC PARTS INCLUDING BUT F. PRIOR TO THE EFFECTIVE DATE OF THIS AGREEMENT; ANY COSTS TO REPAIR ANY PRODUCT SOLD “AS-IS” NOT LIMITED TO PLASTIC PARTS, KNOBS, ROLLERS, BASKETS, SCRATCHES, PEELING AND DENTS; INCLUDING BUT NOT LIMITED TO FLOOR MODELS, O. UNAUTHORIZED REPAIRS AND/OR PARTS; G. DEMONSTRATION MODELS, ETC; PARTS OR REPAIRS DUE TO NORMAL WEAR AND TEAR AND P.
