Common use of Where Homes England Clause in Contracts

Where Homes England. (acting reasonably) considers that the Grant Recipient acted fraudulently or dishonestly in claiming the Firm Scheme Grant for the relevant Firm Scheme, such claim shall be deemed to be a Prohibited Act and Homes England will not be bound by the terms of Clause 18.3.3 (Repayment of Xxxxx).
