Common use of Withdrawal of Plea Clause in Contracts

Withdrawal of Plea. Either party reserves the right to withdraw from this plea agreement for any or no reason at any time prior to the entry of the defendant’s plea of guilty and its formal acceptance by the Court. In the event of such withdrawal, the parties will be restored to their pre-plea agreement positions to the fullest extent possible. The parties understand that if the Court accepts the proposed plea agreement herein, it is bound by the five year (60-month) sentence agreed to by the parties and will enforce it. The parties also understand that if the Court rejects the proposed plea agreement, the defendant will be permitted to withdraw his plea of guilty and the case would go forward as if no plea agreement had been reached.

The parties also understand that if the Court rejects the proposed plea agreement, the defendant will be permitted to withdraw his plea of guilty and the case would go forward as if no plea agreement had been reached.

The parties understand that if the Court accepts the proposed plea agreement herein, it is bound by the five year (60-month) sentence agreed to by the parties sentencing range of between 4 and 5 years imprisonment and will enforce it. The parties also understand that if the Court rejects the proposed plea agreement, the defendant will be permitted to withdraw his plea of guilty and the case would will go forward under the previously returned indictment as if no plea agreement had been reached.

The parties understand that if the Court accepts the proposed plea agreement herein, it is bound by the five seven year (60-84 month) sentence agreed to by the parties and will enforce it. The parties also understand that if the Court rejects the proposed plea agreement, the defendant will be permitted to withdraw his plea of guilty and the case would go forward as if no plea agreement had been reached. If the defendant is ever allowed to withdraw his plea of guilty, the case will go forward under the original indictment, previously returned on June 19, 2007.
