Work by Separate Contractors. Section 4.8.1 The Department reserves the right to perform construction or operations related to the Project with Department’s own forces, and to award separate contracts in connection with other portions of the Project or other construction or operations on the site. Section 4.8.2 Contractor shall afford Department and separate contractor’s reasonable opportunity for the introduction and storage of their materials and equipment and performance of their activities, and shall connect and coordinate Contractor’s construction and operations with theirs as Department may reasonably require. Section 4.8.3 The Contractor shall coordinate its Work with work performed by the Department’s own forces or separate contractors. The Contractor shall participate with other separate contractors and the Department in reviewing their construction schedules. Section 4.8.4 If part of the Work depends for proper execution or results upon construction or operations by the Department or a separate contractor, the Contractor shall, prior to proceeding with that portion of the Work, promptly report to the Department apparent discrepancies or defects in such other construction that would render it unsuitable for such proper execution and results. Failure of the Contractor so to report shall constitute an acknowledgment that the Department’s or separate contractors completed or partially completed construction is fit and proper to receive the Work, except as to defects not then reasonably discoverable. Section 4.8.5 The Contractor shall reimburse the Department for costs the Department incurs that are payable to a separate contractor because of the Contractor’s delays, improperly timed activities or defective construction. The Department shall be responsible to the Contractor for costs the Contractor incurs because of a separate contractor’s delays, improperly timed activities, damage to the Work or defective construction. Section 4.8.6 If a dispute arises among the Contractor and separate contractors as to the responsibility under their respective contracts for maintaining the premises and surrounding area free from waste materials and rubbish, the Department may clean up and allocate the cost among those responsible.
