Common use of XCK Entries Clause in Contracts

XCK Entries. You can use a destroyed check ACH entry (each an “XCK Entry”) if you are: (i) acting in the capacity of a collecting financial institution; and (ii) acting to collect checks that were lost or destroyed in connection with the loss or destruction of an entire cash letter (and not with respect to individually lost or destroyed checks). You acknowledge that any RDFI may, in its sole discretion, refuse to accept and elect to return any XCK Entry. You shall not assert, and we shall not accept, any responsibility for any RDFI refusing to accept or returning any XCK Entry that you initiate.
