Xxxx Payment Service. You can arrange, at your option, for the payment of your current, future and recurring bills from your designated Xxxx Pay Account. For Xxxx Payment Service, your Payee list may include utility companies, merchants, financial institutions, insurance companies, individuals, etc. within the United States whom you wish to pay through Xxxx Payment Service. You must include the full name of the Payee and a complete mailing address and telephone number for each Payee, along with your account number with the Payee, the amount of the Payment, and whether the Payment is recurring. The Financial Institution reserves the right to decline to make Payments to certain persons and entities. You agree that any Payment for taxes, Payments that are court-ordered, government payments and Payments outside of the United States are prohibited and you agree that you will not attempt to use the Service to make these types of Payments. On recurring Payments, it is the responsibility of you or your designated authorized users to update Payee account information as necessary to ensure receipt of payment. Payments are posted against your ledger balance, plus the available credit on your overdraft protection, if any, or other line of credit. 3.8.1. You may schedule Payments to be initiated on a future date, or on the same date of each month. If the transaction shows an In Process status, then the Payment cannot be modified or deleted. Although you can enter Payment information through the Service twenty-four (24) hours a day, seven (7) days a week, the Financial Institution only initiates a Payment on Business Days. Funds must be available in your Account on the scheduled payment date. We may make the Payment either by transferring funds electronically to the Payee or by mailing the Payee a check. Funds will be deducted from your Account on the same Business Day for Electronic Payments. Payments made by check will be deducted from your Account when the check clears your Account. If you direct the initiation of a Payment to occur on a day other than a Business Day, it will be initiated on the following Business Day. The Xxxx Payment Service will indicate whether a Payee is paid electronically or by check. 3.8.2. If Payment is to be made electronically and your Account does not have sufficient funds to make a Payment as of the date the transfer or Payment is attempted or scheduled to be made, the Transfer or Payment may be canceled and no further attempt will be made by Financial Institution to make the Transfer or Payment or notify you. Financial Institution shall have no obligation or liability if it does not complete a Transfer or Payment because 3.8.3. Recurring Payments and Transfers are those made for the same amount, on the same date, on a weekly, bi- monthly, monthly basis, etc. Once started, recurring Payments and Transfers will be made automatically until you delete the Payment or Transfer or upon expiration. Financial Institution shall have no obligation or liability if it does not complete a Transfer or Payment becausebecause there are insufficient funds in your account to process a transaction. In all cases, you are responsible for either making alternate arrangements for the Payment or rescheduling the Payment through the Service. You also authorize us to credit the Payment Account on account of any returned payments from using Xxxx Pay. Xxxx Pay will incur no liability and any service guarantee shall be void if Xxxx Pay is unable to complete any payments initiated because of any of the following: • You have not provided Xxxx Pay with the correct payment account information, or the correct name, address, phone number, or account information for the Merchant upon initiation of the payment; and/or, • Circumstances beyond the control of Xxxx Pay (such as, but not limited to, fire, flood, or interference from an outside force) prevent the proper execution of the transaction and Xxxx Pay has taken reasonable precautions to avoid those circumstances; • The payment-processing center is not working properly and you know or have been advised by Xxxx Pay about the malfunction before you execute the transaction; You agree to have available and collected funds on deposit in the designated Payment Account in amounts sufficient to pay for all xxxx payments requested, as well as, any other payment obligations you have to Advia Credit Union. Advia Credit Union reserves the right, without liability, to reject or reverse a xxxx payment if you fail to comply with this requirement or any other terms of this Agreement. If you do not have sufficient funds in the Payment Account and Advia Credit Union has not exercised its right to reverse or reject a xxxx payment, you agree to pay for such payment obligations on demand. All charges are billed by and payable to your Wireless Carrier and are your sole responsibility. You represent that you are the owner, or authorized user of the wireless device you use to receive the service, and that you are authorized to approve the applicable charges. We will send you a message only once, and only with your explicit agreement as indicated by your continuation of the process flow. We will not be liable for any delays or failures in your receipt of any SMS messages as delivery is subject to effective transmission from your network operator and processing by your mobile device. SMS message services are provided on an AS IS, AS AVAILABLE basis. Data obtained from you in connection with the SMS service may include your mobile phone number, your carrier's name, and the date, time, and content of your messages and other information that you may provide. We may use this information to contact you and to provide the services you request from us, and to otherwise operate, develop, and improve the Services. Your wireless carrier and other service providers may also collect data from your SMS usage, and their practices are governed by their own policies. We will only use the information you provide to the Services to transmit your text message or as otherwise described in this Agreement. Nonetheless, we reserve the right at all times to disclose any information as necessary to satisfy any law, regulation, or governmental request, to avoid liability, or to protect our rights or property. When you complete forms online or otherwise provide us information in connection with the Services, you agree to provide accurate, complete, and true information. The Services, as well as the content and materials received through the Services, are proprietary to us and our licensors, and are for your personal and non-commercial use only. You shall not damage, impair, reverse engineer, interfere with, or disrupt the service or its functionality in any way. The Services are available only in the United States. We reserve the right to alter charges and/or these terms and conditions from time to time. We may suspend or terminate the service to you if we believe you are in breach of this Agreement, our terms and conditions, or any terms and conditions provided by our third party service providers. Your access to the Services is also subject to termination in the event your wireless service terminates or lapses. We may discontinue the Services at any time. Advia Credit Union offers the ability to send money online through PayPal. The PayPal services will allow you to transfer funds to another PayPal user online through your designated Payment Account. We offer this service through PayPal, which is a third party service provider. If you use this service, you may need to create an account with PayPal and will be bound the terms and conditions, as well as any user agreements, provided by PayPal. In using the Services, including Xxxx Pay, you understand that the Services and/or the United States Postal Service may return payments for various reasons, such as, but not limited to: the account number being invalid; the Services being unable to locate the account; or the payee account being paid in full. The Services will use its best efforts to research and correct the returned payment, or void the payment and credit your Payment Account. You may receive a notification from the Services concerning such changes. There is no fee for the Services; this is a FREE service with all retail accounts. However, the following charges may apply: • Return deposit items due to customer error $4.00 per item • Stop Payment Fee $20.00 per item • Incoming Collections $20.00 per item • Statement Reconciliation $25.00 per item Additional fees are listed in our Account Fee Schedule brochure. Recurring Payments and Transfers are those made for the same amount, due date reflected on the same date, on a weekly, bi- monthly, monthly basis, etc. Once started, recurring Payments and Transfers will be made automatically until you delete the Payment or Transfer or upon expirationyour Xxxxxx’x statement. If the Payment due date is not on a recurring Paymentnon- Business Day, it will be you must select a “one- time PaymentDeliver By” date that is at least one (1) Business Day before the Xxxxxx’x due date.” One-time Payments do (c) Bank will choose the method by which payments are sent to a Billers (i.e., electronically, by check or otherwise). If the payee is to be paid by paper check, you understand and agree that paper checks are mailed to the payee and that the payee may not recur and are not made until you enter receive the Payee and amount of the current xxxx and submit the Payment. A recurring Xxxx Payment Service transaction that you want deleted must be deleted or the next Payment date changed until five (5) to eight (8) Business Days after the date the check is mailed. If the payee is to be paid electronically, you understand and agree that the payee may not receive the Xxxx Payment until three (3) to four (4) Business Days after the date the Xxxx Payment is debited from the Payment Account. You understand and agree that Bank is not responsible for the timely delivery of mail or the improper transmission or handling of Xxxx Payments by third parties. (d) To cancel a Xxxx Payment other than a preauthorized electronic fund transfer, you or a User must cancel the Xxxx Payment via Online Banking (by following the onscreen instructions) before 5:00 PM (Eastern Standard Time) on the date the Xxxx Payment is scheduled to be debited from your Payment Account. For instructions on canceling or stopping a preauthorized electronic fund transfer, see Section 10, below. If Bank has chosen to make a Xxxx Payment by means of a paper check, you or a User may also be able to stop payment on the paper check by calling Bank at 000-000-0000 or toll free at 000-000-0000 or following the instructions in Online Banking. The stop payment request must precisely identify the name of the payee, the payee-assigned account number, the amount and scheduled date of the Xxxx Payment, and the ID number from the Xxxx Payment “scheduled payments” screen. You will incur regular stop payment charges as disclosed in the current transaction datefee schedule for the applicable Account. (e) You agree not to enter any agreements where one of the purposes is to generate late payment fees. The risk of incurring and the responsibility for paying any and all late charges or penalties shall be borne by you in the event you do not follow the procedures. Bank, through its third party service provider, may be liable for any late payment related charges up to $50.00 should a payment post after its due date as long as you schedule the payment in accordance with this Agreement. Bank will have no liability if the Account does not contain sufficient funds, the payment processing center is not working properly and you know or have been advised about the malfunction prior to execution of the transaction, the information you provided regarding the Xxxxxx is inaccurate, or for circumstances outside the control of Bank. Bank discourages you from using Xxxx Payment to make tax payments and court ordered payments. Bank will not be liable for any late payment charges related to these types of payments regardless of whether you followed the scheduling requirements set forth in this Agreement. (f) To the extent the automated clearinghouse network is used to facilitate a Xxxx Payment (typically, Xxxx Payments sent electronically), you agree to be bound by the NACHA Rules.
