The Xxxx Pay service can be accessed only via Online Banking and is a separate service made available to you after your enrollment online and Financial Institution approval of that enrollment. Participation in Xxxx Pay is voluntary and may incur service charges per Schedule A as amended. In participation of Xxxx Pay and in providing the Service with names and account information of Billers to whom you wish to direct payments, you authorize us to follow the Payment Instructions received through the Service. In order to process payments more efficiently and effectively, our Service Provider may edit or alter payment data or data formats in accordance with Xxxxxx directives. When the Service receives a Payment Instruction, you authorize our Xxxx Payment Service Provider to debit your Payment Account and remit funds on your behalf so that the funds arrive as close as reasonably possible to the Scheduled Payment Date designated by you. You also authorize our Service Provider to credit your Payment Account for payments returned to the Service by the United States Postal Service or Xxxxxx, or payments remitted to you on behalf of another authorized user of the service. Our Xxxx Payment Service Provider reserves the right to select the method in which funds are remitted on your behalf to the Xxxxxx. These payment methods may include, but may not be limited to, an electronic payment or an electronic to check payment. You may cancel or edit any Scheduled Payment (if processing has not begun) by following the directions within the Service. There is no charge for canceling or editing a Scheduled Payment. However, once the Service has begun processing a Scheduled Payment, it cannot be cancelled or edited; therefore, a stop payment request must be submitted, as described within this Agreement. The ability of this Financial Institution and its Service Provider to process a stop payment on a Xxxx Payment request will depend on the payment method and whether or not a check has cleared. Although we will make every effort to accommodate your request, we will have no liability for failing to do so. We may also require you to present your stop payment request in writing within 14 days. The charge for each stop payment request will be the current charge for such service as set forth in the bank’s fee schedule. Payments to Billers outside of the United States or its territories are prohibited through the Service. Tax payments and court ordered payments may be scheduled at your own risk. In no event shall this Financial Institution or its Service Provider(s) be liable for any claims or damages resulting from the scheduling of these types of payments. We reserve the right to refuse to pay any Xxxxxx to whom you may direct a payment. You will be promptly notified if we decide to refuse payment to a Xxxxxx; however, notification is not required if you attempt to make a prohibited payment or an exception payment as outlined under this Agreement. d) While it is anticipated that most Xxxx Payment requests will be processed and remit funds completed on your behalf so the Business Day after the Customer’s selected Xxxx Payment process date, the Customer agrees that due to circumstances beyond the control of the Bank some Xxxx Payment requests may take longer to be posted to the account at the Specified Entity. The Customer agrees that the funds arrive as close as reasonably possible to the Scheduled Payment Date designated by you. You also authorize our Service Provider to credit your Payment Account Bank will not be responsible for any payments returned to the Service that are received or posted by the United States Postal Service or XxxxxxSpecified Entities after the grace period, or payments remitted to you on behalf that result in a late charge or penalty assessed by the payee, if the Customer does not follow this recommendation. The Xxxx Payment Service permits you to initiate and authorize use your Internet-enable device to direct payments from your account(sdesignated online Xxxx Pay Account to third parties you wish to pay. Your Xxxx Pay Account must be a checking account. You may designate multiple Xxxx Pay Accounts. Through the Xxxx Payment Service, you can pay bills from your Xxxx Pay Account to businesses or individuals. While Catskill Xxxxxx Bank coordinates the Xxxx Payment Service with XXX, XXX performs all functions in connection with the Xxxx Payment Service. By using the Xxxx Payment Service, you acknowledge and agree that XXX is solely responsible for administration of the Xxxx Payment Service and waive all claims against the Bank arising out of your use of such Service. All payments you make will be deducted from the Account that you designated for that payment. Any payments you wish to make through this Service must be payable in U.S. dollars to a payee located in the continental United States. XXX reserves the right to restrict types of payees to whom payments may be made using the Service from time to time. You should not use the Xxxx Payment Service to make payments to settle securities purchases, payments to interest bearing accounts, tax payments, or court ordered payments. Payments for these payees will be your sole responsibility if delayed or improperly processed or credited. Funds must be available in your Xxxx Pay Account on the scheduled payment date. If the date you schedule a payment to be initiated falls on a non-business day (Saturday, Sunday or holiday), funds must be available in your Xxxx Pay Account the previous business day (e.g., Friday). Funds are withdrawn from your Xxxx Pay Account immediately when the payment is sent electronically. Payments sent by check will be deducted from your Account when the check is presented for payment by the payee. You may choose to schedule payments to recur in the same amount at regular weekly, bi-weekly, monthly, semi-monthly, quarterly, annual or semi-annual intervals (a “recurring payment”). If a recurring payment is chosen, the xxxx will be paid automatically each billing period. If the payment is not a recurring payment, it will be a “one-time payment”. One-time payments are not made until you enter the amount of the current xxxx and the date of payment. You may also change or skip payments that are recurring payments. However, you must allow at least three (3) business days after we receive any change to information you have given us about a payee for XXX to reflect the change in its records. When you create a new payee in the Xxxx Payment Service, it has a temporary status until XXX has had sufficient time to set up the account, and, for your business payees, which to verify information about your Account. You should schedule a payment to a new payee at least ten (10) business days before any payment due date, to allow XXX time to set up the payee and verify information about your Account with the payee. For all subsequent payments, you should allow for a reasonable time period, generally at least 3 to 4 business days for electronic payments and 5-7 business days for check payments between the date you schedule a payment to be initiated and the payment due date (that is, the due date shown on your invoice or provided in your agreement with the payee, not taking into account any applicable grace period). If you do not, you will be fully responsible for all late fees, finance charges or other action taken by the payee. Catskill Xxxxxx Bank does not have any duty to monitor the payments that are made through the Xxxx Payment Service. XXX and Catskill Xxxxxx Bank are only responsible for exercising ordinary care in processing and sending payments upon your authorization in accordance with this Agreement.
