Xxxxxx S.C. for Trinidad and Tobago submitted that no claim for a finding of contempt against Guyana had been made in the original or amended application. Accordingly, neither the Respondent, Guyana, nor Trinidad and Tobago as an intervener had notice of the new claim against Guyana. Counsel for Guyana endorsed this submission. [13] The Court holds that if it has jurisdiction in civil contempt (which is doubtful) proceedings for civil contempt should be specifically directed to and served on the alleged contemnor, who should be given an adequate opportunity to prepare a defence in advance of the hearing. Because of the lateness of the Applicants’ oral application no such opportunity was afforded Guyana or indeed the States Parties invited to make submissions on the contempt application before the Court. In the circumstances the Court rules that the oral claim for a finding of contempt against Guyana was not properly raised.
