Notwithstanding the foregoing, each Party acknowledges that the Services are provided over the Internet and third party equipment and networks with inherent risks and vulnerabilities. Neither Party will be responsible for nor liable to the other Party if such Party fails to detect or prevent one or more incidents of hacking, intrusion, loss of data, or other security breaches. MASERGY MAKES NO WARRANTY, GUARANTEE, OR REPRESENTATION, EXPRESS OR IMPLIED, THAT ALL SECURITY THREATS AND VULNERABILITIES WILL BE DETECTED OR THAT THE PERFORMANCE OF THE MASERGY EQUIPMENT OR THE SERVICES WILL RENDER CUSTOMERS’ SYSTEMS INVULNERABLE TO SECURITY BREACHES.
