Xxxxxxxxxxx of contract. A Member convicted of a felony shall be dismissed or not reemployed. A Member may be dismissed or not reemployed after a finding by a court of competent jurisdiction that such Member has engaged in criminal sexual activity or sexual misconduct that has impeded the effectiveness of the Member's performance. (2006) DISMISSAL Before a Member may be dismissed or not reemployed, the Board shall send a copy of the Superintendent's recommendation to the Member by certified mail, restricted delivery, return receipt requested, by personal delivery to the Member with a signed acknowledgement of receipt, or by delivery by a process server. By the same manner, the Board shall notify the Member of said Member's right to a hearing before the Board and the date, time, and place set by the Board for the hearing, which shall be held not sooner than twenty (20) days or later than sixty (60) days after the Member's receipt of notice. At said hearing the Member shall be entitled to all rights guaranteed under such circumstances by the U.S. Constitution and the Constitution of Oklahoma. Notice to a probationary Member shall specify the cause upon which the recommendation is based. Said notice shall also specify the underlying facts supporting the recommendation. The Board shall notify the probationary Member of its decision, including the basis for the decision, by certified mail, restricted delivery, return receipt requested, by personal delivery to the Member with a signed acknowledgement of receipt, or by delivery by a process server. The Board's decision regarding a Member shall be final. Notice to a career Member shall specify the statutory grounds upon which the recommendation is based. Said notice shall also specify the underlying facts supporting the recommendation. The Board shall notify the career Member of its decision, including the basis for the decision, by certified mail, restricted delivery, return receipt requested, by personal delivery to the Member with a signed acknowledgement of receipt, or by delivery by a process server. The Member shall receive any compensation and benefits to which said Member is otherwise entitled until such time as the Board's decision becomes final. Provided, however, if the hearing for a Member is for non- reemployment of the Member, such compensation and benefits may be continued only until the end of said Member's current contract. (2011)
