AGREEMENT made as of ________________, by and between The FBR Funds, 1001 19th Street North, Arlington, Virginia 22209 (the “Trust”), on behalf of the portfolios of the Trust listed on Exhibit 2, as may be amended from time to time (individually referred to herein as a “Fund” and collectively as “Funds”), and FBR National Trust Company, a national trust company, having its principal office and place of business at 4922 Fairmont Avenue, Bethesda, MD 20814, on behalf of itself and its affiliates (the “Company”).
