CUSTOMER and Fermic shall be separately referred to hereafter as a “Party” and collectively referred to as “Parties”. RECITALS CUSTOMER owns Patents (as defined below), patents pending and Know-How (as defined below) concerning microbial and biochemical processes by which a strain of microorganism was developed and is owned by CUSTOMER (the “Microorganism”).
