Ferratum shall not be held liable for any direct or indirect loss or damage, unless such loss or damage has been caused by Ferratum’s negligence or fraud, or unless caused by a failure by Ferratum to fulfil an obligation constituting one of the fundamental elements of theCredit Agreement.
