Information. Sans préjudice des articles 27 et 28 de la convention, les États parties échangent, conformément à leurs systèmes juri­ diques et administratifs respectifs, des informations pertinentes, dans chaque cas d’espèce, concernant notamment les fabricants, négociants, importateurs, exportateurs et, chaque fois que cela est possible, transporteurs autorisés d’armes à feu, de leurs pièces, éléments et munitions.

Information. 11.1 The Merchant at PayU request shall disclose to PayU such information as that PayU may reasonably require for the provision of the Services, including any information required to satisfy the reporting or other obligations (including financial obligations) concerning the Merchant under this Agreement, any Payment Scheme Rule and / or Applicable Law. 11.2 The Merchant shall immediately notify PayU of a material change in information mentioned above, including any material change in the financial position of the Merchant for the duration of the provision of the Services. 11.3 PayU may retain information disclosed by the Merchant as long as it may be required by Applicable Law or as per the contractual obligation with PayU. 11.4 Subject to Applicable Law, PayU may use information, collect information and share information with their Affiliates, Card Issuers, Payment Schemes, credit reference agencies, fraud prevention agencies and crime enforcement authorities to the extent PayU may reasonably consider necessary or appropriate for the provision of the Services and/or compliance with this Agreement, Applicable Law and Payment Scheme Rules. In case of rendering credit (loan) services for the ▇▇▇▇▇▇▇▇’▇ Clients, such information may be used by other credit providers to take decisions about the Merchant and their financial associates. 11.5 The Merchant acknowledges and agrees that: 11.5.1 Payment Schemes to which PayU disclose information may (i) maintain databases (which may be available to third parties including Card Issuers, regulators and other authorities) containing information regarding the conduct of transactions by merchants; and/or (ii) categorise undesirable conduct of merchants; and 11.5.2 If any of the Services or this Agreement are terminated pursuant to clause 19, relevant Payment Schemes may, subject to Applicable Law, be notified and may retain such information. 11.6 PayU shall have no liability to the Merchant for any inaccuracy in the information obtained from the Merchant and provided to any third parties pursuant to this clause 11, provided it acted in good faith.

  • Důvěrné informace Pro účely této smlouvy se za důvěrné informace považují následující: informace označené objednatelem za důvěrné, informace podstatného a rozhodujícího charakteru o stavu provádění díla, informace o finančních závazcích objednatele vzniklých v souvislosti s prováděním díla, informace o sporech mezi objednatelem a jeho smluvními partnery v souvislosti s prováděním díla. Za důvěrné informace nebudou považovány informace, které jsou přístupné veřejně nebo známé v době jejich užití nebo zpřístupnění třetím osobám pokud taková přístupnost nebo známost nenastala v důsledku porušení zákonem uložené nebo smluvní povinnosti zhotovitele. Zhotovitel se zavazuje, že bez předchozího souhlasu objednatele neužije důvěrné informace pro jiné účely než pro účely provádění díla a splnění povinností podle této smlouvy a nezveřejní ani jinak neposkytne důvěrné informace žádné třetí osobě, vyjma svých zaměstnanců, členů svých orgánů, poradců, právních zástupců a subdodavatelů. Těmto osobám však může být důvěrná informace poskytnuta pouze za té podmínky, že budou zavázáni udržovat takové informace v tajnosti, jako by byly stranami této smlouvy. Pokud bude jakýkoli správní orgán, soud či jiný státní orgán vyžadovat poskytnutí jakékoli důvěrné informace oznámí zhotovitel tuto skutečnost neprodleně písemně objednateli. V případě poskytnutí důvěrné informace je zhotovitel povinen vyvinout maximální úsilí k tomu, aby zajistil, že s nimi bude stále zacházeno jako s informacemi tvořícími obchodní tajemství podle § 504 OZ. V případě, že se zhotovitel dozví nebo bude mít důvodné podezření, že došlo ke zpřístupnění důvěrných informací nebo jejich části neoprávněné osobě nebo že došlo k jejich zneužití, je povinen o tom neprodleně písemně informovat objednatele. Bez předchozího písemného souhlasu objednatele nesmí zhotovitel fotografovat ani umožnit kterékoli třetí osobě fotografování díla k propagačním nebo reklamním účelům ani nebude sám nebo s třetí osobou publikovat žádné texty, fotografie nebo ilustrace vztahující se k dílu. Objednatel si vyhrazuje právo schválit jakýkoli text, fotografii nebo ilustraci vztahující se k dílu, které zhotovitel hodlá použít ve svých publikacích nebo propagačních materiálech.
