Common use of Limitation of Liability Clause in Contracts

Limitation of Liability. 11.1 CzMVO does not warrant that the CzMVS will not contain any errors or defects (whether visible, hidden or likely to occur in the future). CzMVO does not warrant that the CzMVS will function without faults. 11.2 CzMVO shall not be liable for the actions of EMVO and of the persons to whom access to the CzMVS and the EMVS has been provided in compliance with applicable legislation. CzMVO shall not be liable for the content, integrity, or completeness of the Data in the CzMVS or the EMVS and for such Data being up to date. 11.3 The total aggregate liability of CzMVO towards the Company under this Agreement will be limited to the amount of payments received by CzMVO from the Company under this Agreement in the calendar year in which the damage occurred. The limitation of liability will not apply, if the damage has been caused by wilful misconduct or gross negligence.
