Open source software and Third Party Software. 10.1. Software provided by Soley within the scope of Contractual Services may contain open source software. For open source software, instead of the GTC, exclusively the relevant open source license terms apply, available at ▇▇▇▇://▇▇.▇▇▇▇▇.▇▇/▇▇▇▇▇▇▇▇▇▇▇▇▇▇. For information about the used open source software section 14 applies; the rights of the customer according to the respective relevant open source license conditions remain unaffected.
10.2. Zur ordnungsgemäßen Verwendung erbrachter Vertragsleistungen, insbesondere überlassener Software können zudem proprietäre Softwareprodukte von Drittherstellern („Drittherstellersoftware“) erforderlich sein. Vertragsleistungen sind ohne die in den Systemanforderungen benannte Drittherstellersoftware für den Kunden möglicherweise nicht oder nur eingeschränkt nutzbar. Soweit nicht abweichend vereinbart, ist für deren Beschaffung, Betrieb und Pflege im Verhältnis zu Soley alleine der Kunde verantwortlich. Darüber hinaus kann von Soley überlassene Software ihrerseits Drittherstellersoftware enthalten, für welche die Bestimmungen der AGB gelten.

The Product may contain open source software (i.e., software that is subject to an open source license such as the GNU General Public License, Library General Public License, Lesser General Public License, Mozilla License, Berkeley Software Distribution License, Open Source Initiative License, MIT License, Apache License, public-domain license or similar types of open source license). The Product may also contain software provided by a third-party. The use of any third-party software and open source software is contingent on your express acceptance of the respective license term. A list of license terms relating to third-party software and open source software is available at ▇▇▇.▇▇▇▇.▇▇. dots does not provide any guarantee regarding the open source software and third-party software contained in the Product. Liability and warranty is limited to proprietary parts of the Products (i.e., parts of the Product developed by dots itself) and is solely governed by Sections 3, 4 and 5 of this Agreement. Any limitation of liability and disclaimer provided in this Agreement relates to the Product as a whole, including third party and open source software components.
