Liability-Definition

Liability. The contractor and TGW shall be liable in accordance with the legal requirements; a liability for loss of profit shall however be excluded.
Liability. The lessor shall be liable for proper reservation and fulfilment of the contract in accordance with the contract. In the event of damage other than personal injury, liability shall be limited to twice the rental charge, except in the case of gross negligence or wilful misconduct. Liability is excluded for failures on the part of the hirer or co-user, unforeseeable or unavoidable failures on the part of third parties, force majeure or events which the lessor, key holder, agent or other persons appointed by the lessor could not foresee or avert despite due care. The Hirer shall be liable for all damage caused by him or co-users, fault shall be presumed.
Liability. The contractor is liable for any breach of duty and the resulting damage, unless he can prove that he is not responsible for the breach of duty. He is also obliged to indemnify Amprion against all claims for damages asserted by third parties against Amprion for reasons based on a defect in the delivery/demand of the contractor, unless the contractor proves to Amprion that he is not responsible for the event causing the damage. The above controls also apply if the contractor uses the services of a vicarious agent.
