  • If mediation does not resolve the dispute then the parties agree that: for a dispute where under $150,000.00 is at issue they will jointly select an arbitrator, and where the parties do not agree on the choice within 10 days, then ADR Chambers shall appoint a single arbitrator from its roster.

  • If the parties cannot themselves agree on a mediator, one will be appointed by ADR Chambers from its roster of mediators.

  • Neither ADR Chambers nor any member of the Arbitral Tribunal shall be liable to any Party or any counsel, officer, director, employee or witness for any Party for any act or omission in connection with any arbitration.

(or such later version thereof as may be acceptable to the applicable Issuing Bank and in effect at the time of issuance of such Letter of Credit).
