Aggregate Deposits means the amount of aggregate deposits of Public Funds of Governmental Units that are collateralized by a depository through the pooling method as specified in Neb.Rev.Stat.
All interest, if any, earned on the Aggregate Deposits shall be returned to Parent following the termination of the Escrow Account.
Should the Escrow Agent become liable for the payment of taxes, including withholding taxes, relating to income derived from any Aggregate Deposit or any payment made hereunder, the Escrow Agent may pay such taxes from the Aggregate Deposits.

To the extent the actual aggregate deposits exceed the Aggregate Deposits the Parties have agreed to negotiate in good faith to find a solution for any amount exceeding the Aggregate Deposits (“Additional Aggregate Deposits”).
Such notice shall specify the disposition by the Escrow Agent of the Aggregate Deposits.
To the extent there are Additional Aggregate Deposits, the Asphalt Site Deposit will be reimbursed according to the terms of the agreement reached by the Parties if applicable.
All interest earned on any Aggregate Deposits shall be considered the currently reportable income of Parent for federal income tax purposes.
