Air Permits shall have the meaning as set forth in Section 10.6.

Air Permits means the City of New York, the State of New York and U.S. Environmental Protection Agency permits or other Governmental Actions relating to the emission of air Contaminants required for the operation of the Facility or a Turbine Unit in order for the Facility or such Turbine Unit to operate under the Environmental Requirements.

Parts 50 - 96 (whether such requirements are implemented by the federal Environmental Protection Agency and/or by the Georgia Department of Natural Resources pursuant to state regulations adopted in connection with its federally-approved state implementation plan) and, in particular, approvals as applicable for (i) prevention of significant deterioration of air quality by proposed new or modified sources in an attainment area (see 40 C.F.R. § 51.166, and Georgia Rule 391-3-1-.02(7), as such requirements may be amended or modified), and (ii) a Clean Air Act Title V operating permit as may be required for potential emissions of NO2 and CO (see 40 C.F.R. Part 70, and Georgia Rule 391-3-1-.03(10), as such requirements may be amended or modified).

Air Permits means permits issued by the air pollution control district or air quality management district with jurisdiction over the Facility.

Air Permits means the modified or reissued Louisiana Department of Environmental Quality permits number 0520-00219-V1 (Part 70 Permit and state preconstruction permit) and number 0520-00219-IV0 (Acid Rain Permit).
