Appointment as Sub-Adviser. The Adviser hereby retains the Sub-Adviser to act as investment adviser for and to manage the Sub-Adviser Assets, subject to the supervision of the Adviser and the Board and subject to the terms of this Agreement; and the Sub-Adviser hereby accepts such employment. In such capacity, the Sub-Adviser shall be responsible for the investment management of the Sub-Adviser Assets. The Sub-Adviser agrees to exercise the same skill and care in performing its services under this Agreement as the Sub-Adviser exercises in performing similar services with respect to other fiduciary accounts for which the Sub-Adviser has investment responsibilities.
Appointment as Sub-Adviser. Subject to and in accordance with the provisions hereof, Manager hereby appoints Sub-adviser as investment sub-adviser to perform the various investment advisory and other services to the Portfolio set forth herein and, subject to the restrictions set forth herein, hereby delegates to Sub-adviser the authority vested in Manager pursuant to the Management Contract to the extent necessary to enable Sub-adviser to perform its obligations under this Agreement.
Appointment as Sub-Adviser. The Adviser hereby appoints the Sub-Adviser to act as investment adviser for and to manage the Sub-Adviser Assets for the Fund(s) listed on Exhibit A, subject to the supervision of the Adviser and the Company’s Board of Directors, and subject to the terms of this Agreement; and the Sub-Adviser hereby accepts such appointment. In such capacity, the Sub-Adviser shall be responsible for the investment management of the Sub-Adviser Assets. The Sub-Adviser agrees to exercise the same degree of skill, care and diligence in performing its services under this Agreement as the Sub-Adviser exercises in performing similar services with respect to other fiduciary accounts for which the Sub-Adviser has investment responsibilities, and that a prudent manager would exercise under the circumstances.
Appointment as Sub-Adviser. The Trust being duly authorized hereby appoints and employs The Tuckerman Group, LLC (the "Sub-Adviser") as the discretionary portfolio manager of the Fund, on the terms and conditions set forth herein.
Appointment as Sub-Adviser. The Trust being duly authorized hereby appoints and employs PADCO Advisors, Inc., d/b/a Rydex Investments (the "Sub-Adviser") as the discretionary portfolio manager of the Fund, on the terms and conditions set forth herein.
Appointment as Sub-Adviser. The Adviser hereby appoints the Sub-Adviser to provide certain investment advisory services to the Adviser and the Fund for the period and on the terms set forth in this Agreement. The Sub-Adviser accepts such appointment and agrees to render the services herein set forth, for the compensation herein provided. The Sub-Adviser shall for all purposes herein be deemed to be an independent contractor of the Adviser and the Trust and shall, unless otherwise expressly provided herein or authorized by the Adviser or the Board of Trustees of the Trust (the “Board”) from time to time, have no authority to act for or represent the Adviser or the Trust in any way or otherwise be deemed an agent of the Adviser or the Trust.
Appointment as Sub-Adviser. The Manager hereby appoints the Sub-Adviser to act as sub-adviser to the Fund to manage that portion or all of the assets of the Fund that the Manager from time to time upon reasonable prior notice allocates to, and puts under the control of, the Sub-Adviser (the “Sub-Adviser Assets”) subject to the supervision of the Manager and the Board of Directors of the Fund and subject to the terms of this Agreement; and the Sub-Adviser hereby accepts such appointment. In such capacity, the Sub-Adviser shall be responsible for the investment management of the Sub-Adviser Assets. It is recognized that the Sub-Adviser and certain of its affiliates now act, and that from time to time hereafter may act, as investment adviser to one or more other investment companies and to fiduciary or other managed accounts and that the Manager and the Fund cannot object to such activities.
Appointment as Sub-Adviser. The Trust being duly authorized hereby appoints and employs Xxxxxx Capital Management Limited (the "Sub-Adviser") as the discretionary portfolio manager of the Fund, on the terms and conditions set forth herein.
Appointment as Sub-Adviser. The Adviser hereby appoints the Sub-adviser to act as investment adviser for and to the assets of the Fund (the “Sub-adviser Assets”) subject to the supervision of the Adviser and the Board of Trustees of the Trust and subject to the terms of this Agreement; and the Sub-adviser hereby accepts such appointment. In such capacity, the Sub-adviser shall be responsible for the investment management of the Sub-adviser Assets allocated to it. It is recognized that the Sub-adviser and certain of its affiliates may act as investment adviser to one or more other investment companies and other managed accounts and that the Adviser and the Trust do not object to such activities.
Appointment as Sub-Adviser. The Adviser hereby appoints the Sub-Adviser as the discretionary portfolio manager of the Portfolio, on the terms and conditions set forth herein.
