The installations performed by these modes will be considered as the property of the Auxiliary System.
Operator shall obtain, and maintain throughout the term of this Agreement, good title to the Auxiliary System free and clear of any liens, encumbrances, security interests or charges.
The Company's obligation to provide an alternate or supplemental source of steam to meet the steam requirements of Customer and its Ancillary Customers may be satisfied by the installation and operation at the Existing Plant of the Auxiliary System (as defined in the Operating Agreement) in the manner and upon the conditions contained in the Operating Agreement.

Except as otherwise expressly provided in this Agreement, Operator shall not make any alterations, improvements or additions to the Existing Plant, including the Auxiliary System (collectively "alterations") without the prior written consent of Owner, which consent shall not unreasonably be withheld.
All alterations, improvements and additions made to the Existing Plant, except the Auxiliary System, and whether or not affixed or moveable, shall upon installation become the property of the Owner.
