Whenever an employee is absent from work as a result of personal injury occurring in the course of his/her employment, as used and defined in the Workers’ Compensation Laws of Maryland, and such lost time is approved by a Board physician the employee will be paid as close to his/her normal net salary as possible for the period of such absence up to twelve (12) months, and no part of such absence will be charged to his/her annual or accumulated sick leave.
If there is a disagreement between the original physician and Board physician, the two physicians will be asked to select a third physician, at Board expense, to provide a final decision.
In all cases where there is a dispute or difference of opinion between the employee's physician and the Board physician, the two doctors will select a third, and the parties will be governed by the opinion of third physician.
When an educator is absent from school as a result of a physical disability/personal injury caused by an assault arising out of and occurring in the course of his/her employment as used and defined in the Workers’ Compensation Laws of Maryland, and such lost time is approved by a Board physician, the educator will be kept on full pay status for the period of the absence.
