BOC Facility definition

BOC Facility a plant for the production of Product and Argon (the “BOC Plant”), including metering and related facilities, together with interconnected liquid Oxygen Product and liquid Nitrogen Product storage vessels and vaporization equipment (the “Liquid Product Storage Facility”), all connected to the BOC Pipelines and having the production, delivery, liquid storage and vaporization capabilities or capacities stated in Paragraphs II and III of Exhibit A hereto, which shall be owned or leased, maintained and operated by BOC on the BOC Plant Site.
BOC Facility shall have the meaning set forth in the recitals to this Agreement.

Examples of BOC Facility in a sentence

  • Coffeyville Resources shall cooperate with BOC in obtaining and preserving all Permits necessary for the maintenance and operation of the BOC Facility and shall reimburse BOC for the actual cost of such Permits.

  • Prior to obtaining any Permit necessary for the maintenance or operation of the BOC Facility, BOC shall give Coffeyville Resources notice thereof.

  • If obtaining any Permit necessary for the maintenance or operation of the BOC Facility would have the direct or indirect effect of impairing Coffeyville Resources’ ownership, maintenance, operation and/or reasonably contemplated expansion of the Coffeyville Facilities, Coffeyville Resources shall give BOC notice thereof; and the parties shall cooperate to arrive at a fair and equitable resolution of such impairment.

If Sunoco elects to terminate the Agreement pursuant to this Section 9.4.6, then such termination shall be effective on the second (2nd) anniversary of the date of the notice given by Sunoco under this Section 9.4.6.

  • During the Supply Period, Sunoco shall pay sales and use taxes levied by the State of Ohio or any other taxing authority on the sale of Hydrogen and Steam and any other taxes associated with BOC’s supply obligations under this Agreement (other than state and local property taxes imposed on the BOC Facility and any tax based upon the equity or income of BOC).

  • L/C Facility means the letter of credit facility established pursuant to Article III.

  • LNG facility means a terminal which is used for the liquefaction of natural gas or the importation, offloading, and re-gasification of LNG, and includes ancillary services and temporary storage necessary for the re-gasification process and subsequent delivery to the transmission system, but does not include any part of LNG terminals used for storage;

  • Production facility means a facility in California at which gasoline or CARBOB is produced. Upon request of a producer, the executive officer may designate, as part of the producer's production facility, a physically separate bulk storage facility which (A) is owned or leased by the producer, and (B) is operated by or at the direction of the producer, and (C) is not used to store or distribute gasoline or CARBOB that is not supplied from the production facility.
