Capex Cap definition

Capex Cap shall have the meaning given to such term in Section 6.10.
Capex Cap means, with respect to any fiscal year specified in the table below under the caption “fiscal year,” the amount set forth on the table below (or its equivalent in other currencies) opposite such fiscal year: Fiscal Year U.S.$ amount 2022 56,000,000 2023 126,000,000 2024 97,000,000 “Capital Lease Obligations” of any Person, means the obligations of such Person to pay rent or other amounts under any lease of (or other arrangement conveying the right to use) real or personal property, or a combination thereof, which obligations are required to be classified and accounted for as capital leases on a balance sheet of such Person under IFRS, and the amount of such obligations shall be the capitalized amount thereof, determined in accordance with IFRS.
