Category 1 Defect definition

Category 1 Defect means a Defect which requires prompt attention because it represents an immediate or imminent hazard, or there is a risk of immediate or imminent structural deterioration, or there is an immediate or imminent risk of damage to a third party’s property or equipment, or there is an immediate or imminent risk of damage to the environment.
Category 1 Defect has the meaning set forth in Section 9.4.3 of the CMA Specification.
Category 1 Defect means a Defect that necessitates prompt attention because it presents:

Examples of Category 1 Defect in a sentence

  • If DB Contractor fails to properly identify and timely address the hazard mitigation for a Category 1 Defect as described in Section 9.4.5 of the CMA Specification, then notwithstanding that the affected travel lane(s) remain open to traffic TxDOT shall have the right to assess a Lane Rental Charge for a Lane Closure for the relevant travel lane until the hazard to Users has been mitigated.

  • Notwithstanding the foregoing, requirements contained in the CMA Documents relating to actions to be taken in the event of an emergency, the mitigation of a hazard from a Category 1 Defect or other requirements for which it is evident that performance is intended to occur on a non-Business Day shall be required to be performed as specified, even though the date in question may fall on a non-Business Day.

  • Notwithstanding the foregoing, requirements contained in the CMA Documents relating to actions to be taken in the event of an emergency, the mitigation of a hazard from a Category 1 Defect or other requirements for which it is evident that performance is intended to occur on a non-Business Day, shall be required to be performed as specified, even though the date in question may fall on a non-Business Day.

  • Any such upload of Defect information with Category 1 Defect status shall trigger immediate automatic e-mail notification of TxDOT and the Maintenance Manager.

  • Notwithstanding the foregoing, requirements contained in the COMA Documents relating to actions to be taken in the event of an emergency, the mitigation of a hazard from a Category 1 Defect or other requirements for which it is evident that performance is intended to occur on a non-Business Day, shall be required to be performed as specified, even though the date in question may fall on a non-Business Day.

  • The Operating Company shall carry out maintenance of Structures as necessary and or required, and no earlier than every four (4) months or later than every seven (7) months, to meet the requirements of this Section 4 Inspection & Maintenance – Structures unless a Category 1 Defect, Damage to Crown Property or any other damage event in relation to a Structure requires an increase in the frequency of the Cyclic Maintenance of a Structure.

  • Should a Defect meet any of the above criteria, or where notified by TxDOT that a Category 1 Defect exists, DB Contractor shall record it as a Category 1 Defect.

  • TxDOT may at its discretion perform with its own forces the hazard mitigation of a Category 1 Defect affecting a Maintained Element and may notify DB Contractor that it intends to perform or that it has performed the hazard mitigation.

  • Itemisation 83 Separate items shall be provided for repairs and patching in accordance with Chapter II paragraphs 3 and 4 and the following: Group Feature I 1 Temporary repair to carriageway Category 1 Defect.

  • The temporary repair of carriageway pavement Category 1 Defect shall not be measured more than once per carriageway pavement Defect.


More Definitions of Category 1 Defect

Category 1 Defect means a defect which may:
Category 1 Defect means building work that is faulty or unsatisfactory because it either:
Category 1 Defect means any Defect which is not an Incident but otherwise poses a risk to health or safety including those items specified in Appendix A to Schedule 3Payment Mechanism as Category 1 Defects.
Category 1 Defect has the meaning set forth in Section 50.4.3 of Item 50 of the Design-Build Specifications.
Category 1 Defect has the meaning set forth in Section 1.3.2.3 of Exhibit 2 to the Capital Maintenance Agreement.
Category 1 Defect means those defects in or on the Project Network that require prompt attention because they represent an immediate or imminent hazard or because there is a risk of short term structural deterioration.

Related to Category 1 Defect

  • Latent Defect means a defect, inherently lying within the material or arising out of design deficiency, which do not manifest themselves and/or was not reasonably discoverable during Defect Liability period.

  • Construction defect means a deficiency in or a deficiency arising out of the design, specifications, surveying, planning, supervision, or observation of construction or construction of residential improvements that results from any of the following:

  • Qualification Defect With respect to a Mortgage Loan, (a) a defective document in the Mortgage File, (b) the absence of a document in the Mortgage File, or (c) the breach of any representation, warranty or covenant with respect to the Mortgage Loan made by the Company, but, in each case, only if the affected Mortgage Loan would cease to qualify as a “qualified mortgage” for purposes of the REMIC Provisions.

  • Latent Defects means such defects caused by faulty designs, material or work man ship which cannot be detected during inspection, testing etc, based on the technology available for carrying out such tests.

  • Category R CBBCs means a series of CBBCs where the Call Price is different from the Strike Price;

  • Minor defect means a defect which is not a Major Defect.

  • Category 1 means medical education activities that have been designated as Category 1 by the Accreditation Council for Continuing Medical Education (ACCME), the American Osteopathic Association (AOA), a state medical society, or an equivalent organization.

  • Category 3 means a DG facility of greater than 200 kW and not more than 1 MW.

  • Category 2 Training: This category includes services related to training state employees to understand and apply Agile concepts and tools.

  • Title Defect as used herein shall mean any encumbrance, encroachment, irregularity, defect in or objection to Seller’s title to the Interests (excluding Permitted Encumbrances), that alone or in combination with other defects renders Seller’s title to the Interests or part thereof less than Defensible Title.

L. 104-191 as amended by the Health Information Technology for Economic and Clinical Health Act of 2009 (HITECH), 45 CFR Parts 160 and 164; the Family Educational Rights and Privacy Act (FERPA), 20 U.S.C. §1232g; 34 CFR Part 99; Internal Revenue Service Publication 1075 (xxxxx://xxx.xxx.xxx/pub/irs-pdf/p1075.pdf); Substance Abuse and Mental Health Services Administration regulations on Confidentiality of Alcohol and Drug Abuse Patient Records, 42 CFR Part 2; and/or Criminal Justice Information Services, 28 CFR Part 20.

  • Title Defect Amount means, with respect to a Title Defect Property, the amount by which such Title Defect Property is impaired as a result of the existence of one or more Title Defects, which amount shall be determined as follows:

  • Environmental Defect means, with respect to any given Asset, a material violation of Environmental Laws in effect as of the Effective Time in the jurisdiction in which such Asset is located.

  • Mentally defective means that a person suffers from a mental disease or defect which renders the person temporarily or permanently incapable of appraising the nature of his or her conduct. S.C. Code Ann. §

  • Environmental Defect Value means, with respect to any Environmental Defect, the value, as of the Closing Date, of the estimated costs and expenses to correct such Environmental Defect in the most cost-effective manner reasonably available, consistent with Environmental Laws, taking into account that non-permanent remedies (such as mechanisms to contain or stabilize hazardous materials, including monitoring site conditions, natural attenuation, risk-based corrective action, institutional controls or other appropriate restrictions on the use of property, caps, dikes, encapsulation, leachate collection systems, etc.) may be the most cost-effective manner reasonably available.

  • Particulate matter emissions (PM) means the mass of any particulate material from the vehicle exhaust quantified according to the dilution, sampling and measurement methods as specified in this UN GTR.

  • Nonconforming zoning condition means a physical improvement on a property that does not conform with current zoning standards.

  • Congenital Condition(s) means (a) any medical, physical or mental abnormalities existed at the time of or before birth, whether or not being manifested, diagnosed or known at birth; or (b) any neo-natal abnormalities developed within six (6) months of birth.

  • Nonconforming use means a use of land that:

  • Special Category Data means any personal data revealing racial or ethnic origin, political opinions, religious or philosophical beliefs, or trade union membership, and the processing of genetic data, biometric data for the purpose of uniquely identifying a natural person, data concerning health or data concerning a natural person's sex life or sexual orientation.

  • Document Defect As defined in Section 2.03(a).

  • Defective Product has the meaning set forth in Section 5.2.

  • Edible cannabis product means cannabis product that is intended to be used, in whole or in part, for human consumption, including, but not limited to, chewing gum, but excluding products set forth in Division 15 (commencing with Section 32501) of the Food and Agricultural Code. An edible cannabis product is not considered food, as defined by Section 109935 of the Health and Safety Code, or a drug, as defined by Section 109925 of the Health and Safety Code.

  • Title Defects has the meaning set forth in Section 5.15(b).
